Mr. Brock Bowles <br />April 1, 2015 <br />Page 2 <br />Item 2: The landowner would like to raise the water level in Pond 008 in order for his <br />livestock to have easier access and ensure enough volume was stored <br />Response: Pond 008 is designed to contain the 10 -yr 24 -hr event in accordance with the <br />Division's rules. The capacity of Pond 008 is currently approved in the permit and to adjust the <br />capacity of the pond, a hydrology demonstration and a technical revision to the permit would <br />have to be submitted to the Division to make this requested change. However, if WFC can <br />demonstrate through a Phase II bond application that the area supports the post - mining land use <br />and does not contribute suspended solids to streamflow or runoff outside the permit area in <br />excess of pre- mining levels, then WFC could allow Mr. Burbridge to operate Pond 008 as he <br />wishes. There is one area on Mr. Burbridge's property that has not been reclaimed to date. <br />However, you and Mr. Hernandez have suggested a small area exemption (SAE) for all areas <br />that have not received Phase lI bond release to accommodate Mr. Burbridge's request. WFC <br />agrees with this course of action and will evaluate what items are necessary to permit an SAE <br />and allow Mr. Burbridge to operate Pond 008 as he desires as the landowner. <br />Item 3: The landowner would like to adjust his electric fence to be able to graze his horses all <br />summer. <br />Response: WFC is required to maintain control of the agriculture and grazing operations on each <br />parcel of land within the permit boundary in accordance with the permitted revegetation plan. If <br />this control is left to the individual landowners and not in accordance with the approved permit, <br />it would jeopardized and postpone WFC's ability to receive bond release on mined properties. <br />Item 4: The landowner expressed his concerns about the quality of his domestic well water. <br />The quality has deteriorated recently and may be caused by the mining. <br />Response: WFC requested additional information from Mr. Burbridge in regards to the issues <br />associated with the water quality from his well. Mr. Burbridge indicated to Mr. Wolney that the <br />water had an oily residue and sulfur smell. Mr. Burbridge thought that an old well that was close <br />to this well was contaminating his well with ground water, and he mentioned the monitoring <br />wells near his well and wondered if they might be contributing. WFC indicated to Mr. Burbridge <br />that the monitoring wells were drilled and completed into specific strata and were sealed, thus <br />they could not be degrading the water quality in his well. <br />Mr. Wolney also stated to Mr. Burbridge that he could explore any options that he believes were <br />degrading the water quality of his well, and WFC would be open to discussion on how to <br />mitigate the situation. <br />AN EQUAL OPPORTUNITY / AFFIRMATIVE ACTION EMPLOYER <br />A Touchstone Energy`Cooperarive { <br />
