(Tri- State) is providing <br />documentation of surface landowner comments and New Horizon Mine responses on behalf of <br />the Western Fuels- Colorado (WFC), A Limited Liability Company New Horizon Mine. Tri- <br />State is the parent company of Western Fuels- Colorado. The New Horizon Mine operates under <br />Colorado Division of Reclamation, Mining and Safety (Division) Permit No. C -1981 -089. <br />On November 4, 2014, the Division conducted a partial inspection of the New Horizon <br />Mine. During the inspection, you and Mr. Dan Hernandez (Division) met with Mr. Elmer <br />Burbridge regarding concerns he expressed about specific items on his property. On December <br />4, 2014, you met with Mr. Wolney (New Horizon Mine Manager) to discuss these items further. <br />This letter is intended to document the landowners concerns, the comments and commitments by <br />the New Horizon Mine in discussion with Mr. Burbridge, and to provide documentation to the <br />Division for the public record. <br />Item 1: The 4 inch pipe which supplies water to area near the Burbridge home, may be <br />exposed to hazards such as fire if it is left on top of the Pond 008 embankment. <br />Response: This pipe was agreed upon in the original lease to supply water to the area near Mr. <br />Burbridge's home until final bond release (Phase III) was achieved, and the regular supply pipe <br />was installed and in use. In order to further accommodate the landowner, the ownership of this <br />pipe will be transferred to the landowner at bond release and will remain for the surface <br />landowner. WFC also assisted the landowner in procuring a permanent diversion status for this <br />pipe from the CC Ditch Company. WFC buried the pipe up to the pond embankment and left the <br />remainder exposed to avoid disturbing the embankment, which would compromise the stability <br />of the Pond 008 embankment. Mr. Wolney met with Mr. Burbridge again on January 15, 2015, <br />and explained this situation again. Mr. Wolney indicated that WFC is responsible for the pipe <br />until final bond release, and would replace or repair it if any damage occurred prior to final <br />release of his property.
