King Coal Mine (C- 1981 -035) <br />2.05.4 Reclamation Plan <br />MT -07 <br />1. Rule 2.05.4(2)(b): The estimated reclamation costs for the King Coal Mine have been <br />updated by the Division to reflect 2014 unit costs. The revised reclamation cost estimate <br />is $884,249.71. The detailed cost estimate is attached for your review and comment. <br />Please update Appendix 12, Reclamation Bond Estimate, with the most recent reclamation <br />cost estimate (Midterm Review No. 7). <br />2. Rule 2.05.4(2)(f) and 4.11.1 Disposal of debris, acid- and toxic - forming materials <br />constituting a fire hazard. The Division was unable to find the section of the permit that <br />addresses the requirements of 2.05.4(2)(f). Please amend the permit to address this rule; <br />alternatively, please inform the Division where the information may already be found. <br />2.05.6 Mitigation of Impacts of Mining Operations <br />1. Rule(s) 2.05.6(2)(a) -(c), 4.04(1)(a), and 4.18- Based on the requirements of Rule <br />2.05.6(2)(a) -(c), C- 1981 -035 is required to contain a fish and wildlife plan consistent with <br />Rule 4.18. Based on the information presented in Appendix 8 of C- 1981 -035, provided by <br />both the USFWS and the CPW, due to the small size of the overall disturbance area the <br />potential impacts to wildlife are minimal. However, Appendix 8 also includes a list of <br />species that are found in La Plata County and which may occur within the permit area; as <br />such there is no specific fish and wildlife plan in accordance with 2.05.6(2)(a) -(c) which <br />specifically discusses how the plan will minimize disturbances and adverse impacts on fish <br />and wildlife and related environmental values during mining and reclamation operations <br />found or potentially found within the permit and adjacent areas. <br />a. Please submit a fish and wildlife plan consistent with Rule 4.18 based on the <br />determination that there will be impacts to fish and wildlife. <br />b. If an update to the information to include new or added T &E species, and discussion <br />of potential impacts to current State and Federal Threatened and Endangered plant <br />and animal species lists, shows that the plan will require compliance with Rule <br />2.05.6(2)(a)(iii)(A) and (B), please include the information with the plan. <br />2. A determination of the probable hydrologic consequences is presented in Section 2.05.6 <br />of the approved permit application package. GCC has predicted that there will not be any <br />negative impacts to the hydrologic balance. Under 2.04.7, above, the Division has <br />requested that the baseline hydrology sections of the permit be updated. Please update <br />the discussion of probable hydrologic consequences to incorporate any new information <br />that is obtained, in accordance with 2.05.6(3)(b)(iii). <br />2.10 Maas and Plans <br />1. 2.10.1 sets forth general requirements for maps. Map King 1 -001 does not identify the <br />Townships and Ranges. Map King 11 -001 is at a scale of 1" = 2.7 miles, and does not legibly <br />detail the information shown on the 1:24,000 USGS series; nor is the permit area <br />boundary for the King Coal Mine shown. Please revise Maps 001 to comply with Rule <br />2.10.1 <br />Page 14 of 16 <br />
