King Coal Mine (C- 1981 -035) <br />MT -07 <br />application for finding of reasonable diligence needs to be filed with the Water Clerk <br />during April of 2017. <br />3. Map King 1 -008 consists of a cross section showing surface topography and projected <br />subsurface geology. Please revise Map King 1 -004 (Geology /Hydrology) to show the <br />location of the cross section depicted on Map King 1 -008. <br />2.04.11 Fish and Wildlife Resources Information <br />1. The fish and wildlife study required under 2.04.11 consisted of a review of the wildlife <br />species lists on the Natural Diversity Information Source of the DPW and the Colorado <br />Natural Areas Program database for the areas of the King I and II Mines. These queries <br />were conducted in 2005 and 2006 for the King 11 application. A new survey was conducted <br />for development drilling locations at King 11 in 2014. King 11 Appendix 8 includes a list of <br />potential species within the permit area. Please update the information to include new or <br />added T &E species and discuss potential impacts to current State and Federal Threatened <br />and Endangered plant and animal species lists. The Federal and State listed species of <br />concern may have changed since the last revision or the issuance of permit. <br />2.05.3 Operation Plan — Permit Area <br />1. Rule 2.05.3(2) Operation Description <br />a. Paragraph (b) requires that all proposed surface disturbances to be associated with <br />the underground mining activities be described and shown on a map. Map King 11- <br />005 illustrates the proposed mine workings, but does not show the locations of drill <br />holes. Please update this map to identify and show locations for the nine <br />development drill holes approved under TR -22. <br />b. The Division understands that other than development of the mains, mining <br />operations at King II have occurred thus far solely within the OSM permit area. In <br />accordance with 2.05.3(2)(b), please amend Map King II -005 to show the proposed <br />timetable for mining the coal resource located within the DRMS permit. <br />2. Rule 2.05.3(4) Ponds, Impoundments, other treatment facilities and diversions. <br />GCC is in the process of preparing a Technical Revision (TR) application to update surface <br />water portions of the King II permit to reflect as -built conditions (this topic is discussed <br />further in the Division's inspection report for Jan. 28, 2015). <br />3. Rule 2.05.3(5) Topsoil <br />a. A narrative about topsoil salvage and storage is found in King II Section 2.05.3 page 6. <br />The required information is available in the narrative. Please include a statement <br />directing the reader to the location of a map which shows the stockpile locations. <br />b. The narrative in King II Section 2.05.3 page 6 states that the topsoil replacement <br />depth will be 6 inches. The narrative in King II Section 2.05.4 page 9 states that the <br />topsoil finished depth will be 12 inches. Please clarify what the final replacement <br />depth of topsoil will be and verify that enough topsoil has been salvaged to achieve <br />the required depth. <br />Page 13 of 16 <br />
