Exhibit D — Mine Plan <br />7. Phase I excavation is complete, except for the stockpiling of clay. Approximately 23.0 <br />acres ( includes both Pre -Law and Post -Law Disturbances as discussed below) of the total 29.0 <br />acre phase have been affected at the time of this conversion. Phase I will be was completed in <br />1992. Phase I was released from the permit area on August 8, 2000. <br />8. Phase II excavation has commenced on the previously amended area, and contains +/- <br />9.9 acres. Approximately 6.75 acres are undisturbed at the time of the conversion. The <br />undisturbed portion of Phase II is intended to function as a buffer area to the planned activities, <br />and if disturbed, will only be marginally affected. Phase III comprises 10.0 acres. Excavation will eewAnmee commenced in 1996, with a <br />completion anticipated in 2986 2046. <br />10. While reclamation of Phases I, II, and III will be reclaimed in succession, as detailed <br />under Exhibit E, reclamation will not commence within a given phase until excavation has been <br />completed. <br />11. Phases IV and V comprise 200 acres each. Exeavation in Phases IV and V will <br />eenimenee in 1995 and 2020 respeetively. Excavation in Phase IV will commence in 2046. <br />Phase V was released in separate acreage reductions on January 14, 2005 and April 10, 2008. <br />The year of completion for these phases Phase IV cannot be projected at this time. <br />12. During the life of the mine major, moderate, and minor disturbance will not exceed 10 <br />acres each (30 acres total). No new lands will be opened up in advance of one years anticipated <br />excavation. This will assist in maintaining site stability by optimizing the benefits of the existing <br />vegetative cover. <br />MANNER AND METHOD OF EXCAVATION <br />13. Existing excavation within mine phases I and II has disturbed only those areas deficient <br />in soil resources. As the excavation approaches temporarily reclaimed lands or undisturbed <br />lands, soil will be veneered and stockpiled. Soil stockpiles will be located on the perimeter of the <br />mine phase involved, or placed immediately onto previously mined areas scheduled for <br />reclamation. Where soil will be stockpiled for more than one growing season, stockpiled soil <br />will be graded to a 3h: I slope and revegetated with the mixture specified under Exhibit E — <br />Reclamation Plan. Additional soil management is specified under Exhibit I — Soils Information. <br />
