Applicant: William A. Rodman <br />'Permit no.: _ 10 $94) -F <br />Page 2 <br />12. Well Permit No. 3597 -F -R, issued on November 16, 1993, was constructed on December <br />10, 1993, as a replacement to Well Permit No. 3597 -F -R (issued June 24, 1975). The well <br />was constructed to a depth of 36 feet, and was perforated in the interval between 19 feet and <br />36 feet below ground surface. In a pump test conducted on December 13, 1993, this well <br />produced 35 gpm. <br />13. A field inspection conducted on April •6, 2000, by Division of Water Resources personnel <br />found that the well permitted on November 16, 1993, under Well Permit No. 3597 -F -R had <br />continued to be used per its decree. The Feld Inspection Report stated, "This well has lost <br />production and lost its irrigation capabilities, hence a redrill is needed. The well is in the <br />[Cache laj Poudre Augmentation Plan." <br />14. Well Permit No. 3597 -F -R was issued on August 16, 2000, for the replacement of the well <br />permitted on November 16, 1993, under Well Permit No. 3597 -F -R The well was <br />constructed on October 4, 2000, to a depth of 33 feet, and was perforated in the interval <br />between 13 feet and 33 feet below ground surface. Construction and maintenance of this <br />well is subject to Board of Examiners Variance No. 2000 -148A was issued on October 12, <br />2000, as a follow -up to a verbal variance approval granted on October 4, 2000. In a pump <br />test conducted on November 10, 2000, this well produced 25 gpm. <br />15. At the well's depth of 33 feet, ground water diverted by the subject well would be hydraulically <br />connected to the Cache la Poudre River, which is tributary to the South Platte River System. <br />Diversion of ground water from the well would influence the rate or direction of movement of <br />water in those natural streams or alluviums. <br />16. The Cache Ia Poudre River and the South Platte River System are overappropriated. At some <br />or all times of the year, the water supplies for said stream systems are insufficient to satisfy all <br />of the decreed water rights senior to an appropriation by the applicant. <br />17. The proposed diversion from the subject well would cause depletion to the Cache la Poudre <br />River and the South Platte River System at times when these streams are overappropriated. <br />18. Well Permit No. 3597 -F R, permitted on November 16, 1993, is and the proposed <br />supplemental well will be included in the Cache la Poudre Augmentation Association Plan, <br />decreed by the Division 1 Water Court on February 10, 1976, in Case No. W- 7921(75) for a <br />combined maximum annual appropriation of 15 acre -feet. Operation of these wells and this <br />augmentation plan pursuant to the decree will remedy potential injury to senior water rights. <br />19. The location of the proposed well is more than 600 feet from any existing well completed in <br />the sarne aquifer that is not owned by the applicant. <br />Based on the above, the State Engineer finds that there Is water available for withdrawal by <br />the proposed well and no material injury to vested water rights would result from the issuance of <br />the requested permit subject to the following conditions: <br />a. The use of this well as a supplemental point of diversion to an existing well is a <br />change in water right. This well shall be junior to all vested water rights until such <br />time as the change in water right has been approved by the Division 1 Water Court <br />and the well then must be operated pursuant to the conditions of that decree. <br />
