2.05.6(6)
A subsidence handbook is presented in Volume IIIA, Exhibit 15. This
handbook addresses the necessity for repair and restoration as well as repair
and restoration procedures for transmission lines and towers, surface
streams, ponds, springs, groundwater, landslides and roads and trails.
Additionally, any surface improvements (existing or permitted) which are
damaged or destroyed by subsidence will be restored, rehabilitated or
replaced by the Operator. If deemed necessary by the DRMS and the
surface management agency to provide for continuance of existing land
uses, land- surface contours affected by subsidence will be restored to pre -
mining conditions.
The Operator will repair any mine - related damage and be responsible for
damage to injured parties as it relates to the Bruce Park Dam and Bruce
Park landslide.
The Operator has a court approved augmentation plan (Case Number 99
CW 263) for the Water Rights and the High Value Springs and Ponds
located on USDA -FS Managed Lands. Additionally, the augmentation plan
addresses the BLM's in- stream flow rights in Terror Creek and Hubbard
Creek. The court case is presented in Volume III, Tab 2, Water
Augmentation.
The Operator has under lease 600 shares of the capital stock of the
Overland Ditch and Reservoir Company. The Lease gives the Operator
permission to use the Overland Shares by releasing the Overland Shares
into the Terror Creek drainage at any time deemed necessary. The term
of the Lease Agreement is for five (5) years, commencing on March 1,
2015 and continuing until March 1, 2020, at which time the Operator has
the option to extend the Lease Agreement for an additional five (5) years,
unless terminated earlier as provided for in the Lease Agreement. The
Memorandum of Lease Agreement of Reservoir Company Shares is
provided in Volume III, Tab 1.
PR -14 2.05-166- 03/14
