2.05.6 Mitigation of the Impacts of Mining Operations <br />Applicant - There will not be any special protective measures employed to <br />deal with the sediment ponds due to the perceived risks associated with <br />hazardous concentrations of toxic forming materials. The area where <br />sediment ponds will be constructed received Closure Certification from <br />CDPHE on August 25, 2005 for residential /unrestricted use (Exhibit 15). If <br />the CDPHE has approved the area for residential use, the Applicant <br />doubts there will be hazardous concentrations of toxic water in the ponds <br />that could be harmful to wildlife. <br />(d) Restore, enhance where practicable, or avoid disturbance to habitats <br />of unusually high value for fish and wildlife as identified by the State; <br />Applicant - Reed Wash is part of the Colorado River floodplain which has <br />been designated as critical habitat for endangered razorback sucker and <br />Colorado pikeminnow. Reed Wash has a main channel that contains its <br />normal high flow. The pilings for the rail bridge are located outside of the <br />ordinary high water mark of Reed Wash. As required by USFWS <br />conservation measures; the bridge across Reed Wash and the 100 -year <br />floodplain have been redesigned to include a deck for the length of the <br />bridge. The bridge will be inspected frequently and any materials <br />collected on the deck shall be removed to avoid entry into Reed Wash and <br />the 100 -year floodplain. <br />(e) Restore, enhance where practicable, or maintain natural riparian <br />vegetation on the banks of streams, lakes and other wetland areas; <br />Applicant - To the extent practicable, fringe riparian vegetation along Reed <br />Wash will not be disturbed during the installation of piles for the rail bridge. <br />The riparian vegetation in the non - jurisdictional wetlands will be <br />reestablished during final reclamation. <br />(f) Afford protection to aquatic communities by providing stream channel <br />buffer zones as required in 4.05.18 and 4.20.4 or restoring stream <br />channels as required in 4.05.4; <br />Permit Application 2.05 -51 01/12 <br />
