2.05.6 Mitigation of the Impacts of Mining Operations <br />The Applicants Responses to Rule 4.18(5): Each person who conducts <br />surface coal mining operations, to the extent possible using the best <br />technology currently available, shall: <br />(a) Locate and operate roads so as to avoid or minimize impacts to fish <br />and wildlife species; <br />Applicant - Roads are not located where they would impact fish or wildlife <br />species. Haul road #1 travels through an industrial site where there are <br />no fish or wildlife habitat. Haul road #2, and the access road are located <br />in previously disturbed areas where there are no fish or wildlife habitat. <br />The light use road #1 is located outside of the rail loop. There will be very <br />little use of the light use road. It will be used for pond and ditch <br />maintenance and infrequent rail car inspection and repairs. Berms, <br />ditches and silt fences control runoff from the light use road so impacts to <br />fish and wildlife are minimized. Light use road #2 will provide construction <br />equipment access form 14 Road south of the mainline tracks to the rail <br />spur. The road runs easterly from 14 road approximately 1,000 feet within <br />the Union Pacific right -of -way and then turns to the south and intersects <br />the rail spur on the Applicant's property. Runoff from the light use road will <br />be collected in ditches and a culvert, then passed through a silt fence so <br />impacts to fish and wildlife are minimized. Use of Light use Road #2 will <br />virtually cease after construction of the bridge and rail line is complete. <br />(b) Fence roadways where specified by the Division to guide locally <br />important wildlife to roadway underpasses. No new barrier shall be <br />created in known and important wildlife migration routes as identified by <br />the State; <br />Applicant - Not applicable. No underpasses proposed to which wildlife <br />would be guided by fences. <br />(c) Fence, cover, or use other appropriate methods to exclude wildlife from <br />ponds which contain hazardous concentrations of toxic - forming materials; <br />Permit Application 2.05 -50 01/12 <br />
