• 2.05.3 <br />During late 2004 a light use road was constructed to access the drill site <br />located above the utility bench. The road is approximately 280 feet long with <br />an average grade of about 10% and a pitch grade of 20% for about 130 feet. <br />New light use roads will be reclaimed. Reclamation of the upgraded and <br />refurbished light use roads may involve narrowing the roads so they are <br />compatible with the postmining land use of rangeland and wildlife habitat <br />since roads are necessary to manage both land uses and a light use road <br />network was existing on the property prior to mining. <br />The haul and access road construction will not alter or relocate any drainage <br />ways so no response is required. <br />(iv) The inlet end of all culverts and ditch relief drains will be protected by an end <br />section or a rock or concrete headwall. <br />• (v) The applicant seeks to have the Division approve conducting the proposed <br />surface coal mining activities within 100 feet of the right -of -way line of old <br />State Highway 133 under Rule 2.07.6(2)(d)(iv). It is assumed the right -of- <br />way line for old State Highway 133 is the invert of the borrow ditch. The <br />surface coal mining activities within this right -of -way include sediment pond B <br />& D, a portion of the haul road, portions of the haul road to the gob pile, the <br />gob pile sediment pond, the gob pile topsoil pile and the gob pile cover fill <br />stockpile. The toe of the gob pile is close to being within 100 of the right -of- <br />way. <br />All of the surface coal mining activities are located on surface owned by the <br />applicant. The applicant owns most of the land on both sides of the road <br />where these surface coal mining activities are to be located. The applicant <br />also own most of the land south of the railroad tracks. The surface coal <br />mining activities adjacent to this land include a portion of the haul road. <br />Margie Hamilton owns bare undeveloped land west of sediment pond B. <br />.
