To: Pueblo County Planning Commission <br /> Re:SPECIAL USE PERMIT NO.2006-020-ADMINISTRATIVE REVIEW <br /> Date:December 2,2014 <br /> Page 2 <br /> This correspondence is to update the Pueblo County Department of Planning and <br /> Development and the Pueblo County Planning Commission since the approval of this <br /> Special Use Permit No. 2006-020 on December 20, 2006. This mine is capable of <br /> starting operation immediately as the economy improves& once operational,apply for <br /> continuation with the DRMS. The Special Use Permit was approved with conditions of <br /> approval and staff directive, which the applicant/operator understands and is mindful of <br /> all the requirements and believes that they have been accomplished. The applicant <br /> acknowledges the conditions and commits to adhering to the conditions as written in the <br /> SUP No. 2006-020 dated December 20, 2006. <br /> The applicant also attached a copy of the DRMS 2014 annual review which has been attached <br /> as Exhibit 2 of this staff review. <br /> BACKGROUND <br /> Special Use Permit No. 2006-020 was originally approved by the Pueblo County Planning <br /> Commission on December 19, 2006 with five (5) conditions of approval, three (3) Public Works' <br /> Recommended Conditions of Approval and staff directive. <br /> 1. The special use permit shall be approved for excavation, processing, and stockpiling only, <br /> as well as for one hot-mix (asphalt) plant and one concrete batch plant, all within the 323± <br /> acre areas within Sections 33, 34, and 35, Township 20 South, Range 63 West, as <br /> described in and depicted on Exhibits 1, 2, 3 and 4 of the Special Use Permit No. 2006-020 <br /> Staff Report dated December 6, 2006. Processing shall be restricted to materials excavated <br /> from the site, and shall not include materials from other sites. There shall be no blasting <br /> permitted in association with the approved uses. <br /> 2. Hours of operation for the permitted use shall be limited to Monday through Saturday, and <br /> sunrise to sunset. Should the applicant wish to extend the hours or days of operation, the <br /> applicant must apply for and obtain an amendment to this special use permit, through the <br /> public hearing process. <br /> 3. Prior to commencement of mining activities, the applicant shall provide to this Department <br /> documentation of approved plans and permits, or approved waivers as follows: <br /> • Mined Land Reclamation Board Permit <br /> • Water Quality Control Division - Stormwater Discharge Permit <br /> • Pueblo County Department of Public Works—Access Permit <br /> • Colorado Department of Transportation (CDOT) —Access Permit <br /> The applicant shall provide to the Department of Planning and Development a copy of all <br /> other required Federal, State, and local permit applications, approvals, amendments, <br /> waivers, or releases (e.g., air quality, MLRB, etc.) pertaining to Special Use Permit <br /> No. 2006-020 within 30 days of their submittal to the respective agency, and approval by the <br /> respective agency. <br /> 4. The applicant shall file with the Department of Planning and Development an annual mining <br /> operation and reclamation activities report that addresses compliance with the conditions of <br /> this Special Use Permit. Said report shall be submitted by the first day of the anniversary <br /> month of the approval date of this Special Use Permit. <br />
