To: Pueblo County Planning Commission <br /> Re:SPECIAL USE PERMIT NO.2006-020-ADMINISTRATIVE REVIEW <br /> Date:December 2,2014 <br /> Page 3 <br /> 5. The applicant shall develop, operate, and manage the mining-related activity according to <br /> the rules, regulations, plans and permits administered by the applicable federal, state, and <br /> local agencies. Any violation of a rule, regulation, permit, or plan may result in the <br /> scheduling of a Show Cause Hearing to consider the revocation of Special Use Permit No. <br /> 2006-020. <br /> PUBLIC WORKS' RECOMMENDED CONDITIONS OF APPROVAL <br /> 1. The haul route from the Stage 2 site shall be limited to 39th Lane to State Highway 96. <br /> 2. The applicant shall apply to the Pueblo County Public Works for an access permit for their <br /> proposed Stage 2 access point onto 391h Lane. All conditions associated with said permit <br /> shall be complied with prior to commencing operation of the pit. An approved access permit <br /> shall be deemed as compliance with this condition. <br /> 3. The applicant shall provide a CDOT access permit application to Pueblo County Public <br /> Works for signature as permittee for the access point onto State Highway 96 for 39th Lane. <br /> All conditions associated with said permit shall be complied with prior to commencing <br /> operation of the pit. All costs including design and construction, associated with the permit <br /> will be solely borne by the special use permit applicant. An approved access permit shall be <br /> deemed as compliance with this condition. <br /> DIRECTIVE TO STAFF: The Department of Planning and Development is directed to <br /> conduct an administrative review of the property before the regularly scheduled December, <br /> 2014 Planning Commission meeting and to present a report to the Pueblo County Planning <br /> Commission at its December, 2014 meeting. If the use is not established and/or the <br /> property is not in full compliance with the Pueblo County Code and/or all of the conditions of <br /> approval, the Commission may, at its discretion, direct staff to schedule the permit for a <br /> public hearing at the January, 2015 meeting. The Commission, at its discretion, may also <br /> direct staff to conduct an administrative review and/or schedule the permit for public hearing <br /> at an earlier date, if deemed necessary. THIS DIRECTIVE TO STAFF IS NOT INTENDED <br /> AS A CONDITION OF APPROVAL. <br /> The applicant as previously stated was approved for Temporary Cessation (Exhibit 3— DRMS <br /> Temporary Cessation) on January 15, 2014 from the DRMS. The Temporary Cessation is in <br /> effect as long as the mining operation is resumed within five (5) years, or a request for <br /> extension of the period of Temporary Cessation is requested and in no case shall Temporary <br /> Cessation be continued for more than ten (10) years. <br /> RECOMMENDATION <br /> The applicant is approved for Temporary Cessation through the DRMS; therefore staff <br /> recommends the Pueblo County Planning Commission accept this Administrative Report, <br /> thereby approving the continuance of this permitted use with the existing conditions of approval <br /> and the following Directive to Staff: <br />
