STATE HIGHWAY ACCESS PERMIT #399056 June 7, 199 <br />Issued to Bowie Resources. Inc. <br />TERMS & CONDITIONS (cont'd) <br />noted on [hr design plans. The Colorado Registered Professional Engineer shall seal the.plans in accordance with <br />CRS 12-'_5-I 17 in addition on the first page of the design plans that the following note is required: <br />"This design is in full compliance R'ith Section 4 Of the.State Hi:hw•ay Access <br />Cody.'' CCR 601-I except for [he following approved variances:' <br />[vote: ALL plans mus[ he submi«ed on 11" x 17" sheets at a minimum scale of <br />I"= ?0'. No other plan sheet sizes are authorized. Location drawings may <br />be submitted a[ other scales az approved. <br />24. All construction work mu;[ he under the direction of a Colorado Recistered Professional Eneineer and upon <br />comple[ion of the work. that responsible Ensineer shall submit an "As Built' plans. showins in detail all approved <br />construction chan~_es, moditications and revisions. The "As Built' Plans must be sealed in accordance w•i[h CRS <br />25. It shall be the responsibility of the Permi[[ee to verify the location of the existing utilities and notify all utility <br />owners or operators of any work that might involve utilities within the State Highway right-of--way. Any work <br />necessar}• to protect existing permitted utilities, such az an encasement will be the responsibility of the Permit[ee. <br />Any damage or disruption [o any utilities during the construction shall be the Permittee's responsibility and shall <br />be repaired or replaced at no cost to the Depattment. <br />26. Any damage to any present highway facili[ies including vaffic convol devices shall be repaired immediately at no <br />cos[ to [he Departmen[ and prior to continuing other work. Any mud or other material vacked or o[herwise <br />deposited on [he roadway shall be removed daily or az ordered by the Depanmen[ inspec[or. • <br />27. Areas of roadway and/or right-of-way disturbed during this installation shall be restored to their orisinal <br />condi[ions. to insure proper streng[h. drainage and erosion convol. <br />28. Any incomplete construction activity on the State Highway that must be lef[ overnigh[. shall be barricaded and <br />signed in accordance with the Manual on Uniform Traffic Convol Devices and other applicable standards. <br />29. Open cuts, which are 6 inches in depth, within 30 feet of the edge of [he State Highway vaveled way, wilt no[ be <br />left open at nigh[, on weekends, or on holidays. <br />30. No more than 6 feet of trench areas shall be opened at any one time. Open venches and other excavations within <br />the State Highway right-of-way shall be backfilled and/or paved before 330 P.M. of each working day or be <br />protected in accordance with the M.U.T.C.D. ~" <br />31. The area around the new work shall be well graded to drain. top soiled, fettilized. mulched and re-seeded in <br />accordance with the Department standard specifications. <br />32. When i[ is necessary to remove any highway righ[-of-w•ay fence, the posts on either side of [he access envance <br />shall be securely braced with approved end posts and in conformance with the Depanment's M-607-I standard, <br />before the fence is cut, to prevent slacking of the remaining fence. Ail posts and wire removed shall be returned to <br />the Departmen[. <br />33. All excavations for unlit) lines. culver[s. venches or tunnels shall meet the requiremen[s of the Occupational, <br />Safety and Health Administration (OSHA). Colorado Indusvial Commission, Colorado Division of Mines or the <br />Colorado Depanmen[ of Transportation, whichever applies. <br />34. All work that requires traffic control shall be supervised by a registered professional vaffic engineer or by a vaffic <br />control supervisor certified by the American Traffic Safety Services Association (ATSSA) or the Colorado <br />Contractors Association (CCA). When fla~sins personnel are required, the contractor in accordance with the <br />Department standards shall cer[ify them. ~- <br />35. Construction traffic control devices, when not in use, shall be removed or [urned away from traffic. <br />36. All temporary pavement striping shall be done by the Permi«ee/contractor in conformance with section 6'_7 of The <br />Department's standard specifications (or Road and Bridge Construction (latest edition). <br />z. <br />
