On permanent cessation of active mining operations, EFCI will discontinue its use <br />of the Corley Well and the Corley Company will assume responsibility and liability <br />for subsequent water use, consequent impacts, and any eventual abandonment <br />of the well. <br />4.05.15 WATER RIGHTS AND REPLACEMENT <br />As discussed in Sections 2.04.7, Hydrology Description, and 2.05.6, Mitigation of <br />Surface Coal Mining Operation Impacts, EFCI's mining and related operations are <br />not expected to adversely impact any surface or groundwater rights. <br />Consequently, there is no need to address provisions for replacement of impacted <br />water rights. <br />EFCI currently has the legal right to utilize water from the Corely Mine Well for <br />mining, processing, and related operations. With consumptive use from this well <br />for a period of over ten (10) years, there is no evidence of any reduction in flows <br />or depletion of the associated groundwater reservoir. Therefore no adverse <br />impacts are anticipated. <br />4.05.16 DISCHARGE OF WATER INTO AN UNDERGROUND MINE <br />Water will not be diverted or discharged into any underground mine in <br />conjunction with ongoing mining and reclamation operations at the Southfield <br />Mine. All temporary and permanent diversions within the Southfield Mine and <br />loadout areas have been designed to maintain effective flow under all anticipated <br />conditions. While underground mining operations may result in some ground <br />subsidence, surface subsidence will be limited as discussed in Section 2.05.6, <br />Mitigation of Surface Coal Mining Operation Impacts, and should not result in any <br />alteration of surface flow patterns or drainage of surface water flows into <br />underground mine workings. In addition, EFCI has taken certain specific actions, <br />MR-50 4.05-Z7 Revised -June 2003 <br />
