On permanent cessation of active mining operations, EFCI will discontinue its use
of the Corley Well and the Corley Company will assume responsibility and liability
for subsequent water use, consequent impacts, and any eventual abandonment
of the well.
4.05.15 WATER RIGHTS AND REPLACEMENT
As discussed in Sections 2.04.7, Hydrology Description, and 2.05.6, Mitigation of
Surface Coal Mining Operation Impacts, EFCI's mining and related operations are
not expected to adversely impact any surface or groundwater rights.
Consequently, there is no need to address provisions for replacement of impacted
water rights.
EFCI currently has the legal right to utilize water from the Corely Mine Well for
mining, processing, and related operations. With consumptive use from this well
for a period of over ten (10) years, there is no evidence of any reduction in flows
or depletion of the associated groundwater reservoir. Therefore no adverse
impacts are anticipated.
4.05.16 DISCHARGE OF WATER INTO AN UNDERGROUND MINE
Water will not be diverted or discharged into any underground mine in
conjunction with ongoing mining and reclamation operations at the Southfield
Mine. All temporary and permanent diversions within the Southfield Mine and
loadout areas have been designed to maintain effective flow under all anticipated
conditions. While underground mining operations may result in some ground
subsidence, surface subsidence will be limited as discussed in Section 2.05.6,
Mitigation of Surface Coal Mining Operation Impacts, and should not result in any
alteration of surface flow patterns or drainage of surface water flows into
underground mine workings. In addition, EFCI has taken certain specific actions,
MR-50 4.05-Z7 Revised -June 2003
