reclamation work at the site if the work had to be performed by the Division, including the cost <br />of re- establishing vegetation on any revegetated areas, should those areas fail. The permittee <br />currently has on deposit with the Division one Corporate Surety in the amount of $429,424.00. <br />Based on the updated costs of associated revisions, the direct costs for all reclamation tasks is <br />$163,964.00. Indirect costs consist of the Overhead and Profit costs and the Legal, Engineering, <br />and Project Management costs. Overhead and Profit costs consist of Liability Insurance (% of <br />direct cost), Performance Bond (% of direct cost), Job Superintendent (hourly), and Profit (% of <br />direct cost) which make up the Contract Amount (direct cost + Overhead and Profit). The Legal, <br />Engineering, and Project Management Costs consist of Engineering Work (% of contract <br />amount), and Reclamation Management (% of contract amount) for a Total Indirect Cost of <br />$52,863.30. <br />SECTION IV — MIDTERM ADEQUACY QUESTIONS <br />Pursuant to 2.08.3, the Division finds that the permit application C- 1980 -005 contains three <br />deficiencies following the review for the purpose of fulfilling the requirements of the Colorado <br />Surface Coal Mining Reclamation Act, and the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. The Division requests that the permittee correct the <br />deficiencies by submission of revised permit pages under appropriate revision applications, or by <br />activities on the ground, by October 31, 2014. <br />Item 1: Volume 14, Rule 2.05, Page 2.05.4 -1, Introduction Section, indentifies acres released <br />under SL -1, SL -2, SL -3, and SL -4. Bond release SL -5 for Phase II release of 219.7 acres was <br />approved on October 18, 2014. Please revise page 2.05.4 -1 to incorporate SL -5 in the <br />discussion of acres released. <br />Item 2: Page 1 identifies 386.5 acres of original permit area that includes 271.0 disturbed area <br />acres. Through the Bond Release SL -5 process and the 2012 ARR review, the Division and SCC <br />agreed that the actual disturbance area consists of 271.2 acres of disturbance. Please revise the <br />permit to reflect the actual disturbance acreage of 271.2. <br />Item 3: Volume 14, Rule 2.05, 2.05.3 -2 states that an executed Colorado State Board of Land <br />Commissioners (SLB) request for retention of permanent fencing will be provided prior to Phase <br />II submittal, bond release application SL -6, was submitted on June 4, 2014 which requests Phase <br />III release for the entire 271.2 acres disturbed at the Seneca II Mine. Please provide <br />documentation addressing the SLB request for retention of permanent fencing located with <br />the Seneca II Mine permit boundary. <br />Seneca II Mine -4- 8/1/2014 <br />
