Page 2 July 10, 2014 In accordance with approach nos. 1 and 3, a bond has been obtained for $6,268,550.00 through the Division of Reclamation, Mining,and Safety("DRMS")to assure that depletions from groundwater evaporation do not occur in the unforeseen event, or events, that would lead to the abandonment of the Pit. Depletions Depletions at the Holcim Quarry consist of evaporative losses and operational losses due to dust control and water removed within the mined product. As mentioned above the Applicant is seeking to use the remainder of the changed Porter Ditch water right from Case No. 92CW35 to cover a portion of the evaporation losses from the other ponds on the Holcim Quarry DRMS permitted boundary after the Duck Pond depletions have been augmented.As regards the Duck Pond,the decree in Case No. 92CW35 allows for up to 8.3 acres of exposed groundwater and the associated evaporation depletions from the 8.3-acre pond are identified as 31.13 acre-feet per year. Currently, the exposed groundwater surface area for the Duck Pond is approximately 5.6 acres,while the area of the exposed water at the other three quarry pond areas is currently 7.45 acres (see attached table). Therefore, only 4.8 acres of the other pond areas would need replacement with Upper Ark water. Operational losses include dust suppression and water removed in the mined product. Projected dust suppression needs for the 2014 plan year are.estimated to total 12.00 AF from the Duck Pond and 46.44 AF from the other quarry ponds. Evaporative consumptive use from the 4.8 acres remaining after the changed Porter Ditch water right has been exhausted totals 16.96 AF, bringing the total depletions to 63.40 acre-feet. The total depletions for this SWSP, as shown in the attached Table 2, are estimated to be 54.82 acre-feet. The 54.82 acre-feet does not include the evaporation losses since these depletions are covered by the evaporation loss component of the changed Porter Ditch water right from Case No. 92CW35. Replacements The evaporation losses for the pond areas, up to 31.13 acre-feet,will be covered by the evaporation loss component of the changed Porter Ditch water right from Case No. 92CW35. The remainder of the evaporation losses plus the operational losses, consisting of 63.4 acre- feet, will be replaced from the lease with Upper Arkansas Water Conservancy District. The lease water will be provided from stored water in Twin Lakes Reservoir, or from any other reservoir or place from which the Upper Arkansas Water Conservancy District may legally deliver water, from storage or by exchange. Conditions of Approval I hereby approve the proposed SWSP in accordance with § 37-92-308(5), C.R.S., subject to the following conditions: 1. This SWSP shall be valid for the period of January 1, 2014 through December 31, 2014, unless otherwise revoked, modified, or superseded by decree. Additional SWSPs are required until a court decreed plan for augmentation is obtained for the proposed uses.
