The statutory fee of$300 will be required pursuant to§37-92-308(8), C.R.S. <br /> 2. Well permit no. 76814-F was obtained for the current use and exposed pond surface area of <br /> the quarry in accordance with §37-90-137(2) C.R.S. This permit is no longer valid under <br /> C.R.S. 37-90-137(11) and must be re-permitted in accordance with the actual operation. <br /> 3. The total surface area of the groundwater exposed at the Holcim Quarry site must not exceed <br /> 13.1 acres during the approval period of this SWSP resulting in an annual evaporative loss of <br /> 48.09 acre-feet. <br /> 4: The annual amount of water used at the operation shall not exceed 58.44 acre-feet for dust <br /> control <br /> 5. Total consumption at the Holcim Quarry site must not exceed the aforementioned amounts <br /> unless an amendment is made to this plan. <br /> 6. Approval of the use of the evaporation loss component of the changed Porter Ditch water <br /> right from Case No. 92CW35 will not make the Porter Ditch an alternate point of diversion to <br /> any other ponds located on the Holcim's DRMS permitted boundary and will not relieve the <br /> Applicant from the requirement to obtain a water court decree approved plan for <br /> augmentation to replace depletions to the stream system in time, place and amount. <br /> 7. Approval of this SWSP is for the purposes as stated herein. Any additional uses for which <br /> the water may be used must first be approved by this office. Any future additional historical <br /> consumptive use credit given (e.g. agricultural water transfer)for this site must consider all <br /> previous credits given. <br /> 8. The replacement water, which is the subject of this SWSP, cannot be sold or leased to any <br /> other entity. As a condition of subsequent renewals of this SWSP, the replacement water <br /> must be appurtenant to this site until a plan for augmentation is obtained. All replacement <br /> water must be concurrent with depletions in quantity, timing and locations. <br /> 9. The name, address and phone number of the contact person who will be responsible for the <br /> operation and accounting of this SWSP must be provided with the accounting form to the <br /> division engineer and water commissioner. <br /> 10,Accounting of water in this plan, including stream depletions and replacement water <br /> deliveries, must be provided to the Water Commissioner(Joshua.Kasper@state.co.us) and <br /> Division Engineer(Augmentation.Coord inatorAstate.co.us)on forms and at times <br /> acceptable to them. Said accounting must be received by the 10th of the month following <br /> the month being reported. The name, address, and phone number of a contact person who <br /> will be responsible for the operation and accounting of this plan must be provided with the <br /> report. <br /> 11.All pumping for dust control shall be measured in a manner acceptable to the division <br /> engineer. Permanent records of all diversions must be maintained by the owner(recorded at <br /> least monthly) and submitted to the division engineer and water commissioner as required by <br /> the terms of this SWSP. <br />
