Name of Addressee <br />Page 2 <br />Date <br />The refuse pond has a discharge spillway that was designed to discharge to North Thompson <br />Creek in the event that it becomes full. Please explain the procedures that will be used to de- <br />water the refuse pond if it should become full and potentially discharges before a NPDES permit <br />is obtained. <br />2. Rule 4.05.2(7) states that discharges of water shall be made in compliance with the Colorado <br />Water Quality Control Act and regulations promulgated pursuant thereto, and with the effluent <br />limitations promulgated by the United States Environmental Protection Agency. Please <br />demonstrate compliance with applicable effluent limitations on all discharge leaving the permit <br />area or provide documentation from WQCD that the discharge leaving the permit boundary from <br />Pond P -9 as it is proposed to be configured would not require a discharge permit or be required to <br />be sampled. <br />DRMS: See comments to 41 above <br />The Colorado Division of Water Resources submitted comments in regard to TR -28. The <br />comments were sent to J. E. Stover and Associates, Inc in an email on June 6, 2014 and are <br />available on Laserfiche. Please address the DWR comments. <br />DRMS: resolved <br />The Following questions refer to the maps and revised text submitted for the proposed permit <br />boundary change and re- permitting of the refuse pile pond. <br />4. The legal land descriptions (page 2 -1) were compared to Drawing D-31-21. Both documents were <br />submitted under TR -28 and reviewed for the proposed permit boundary expansion. The <br />following errors and questions pertain to the respective section: <br />a) T 8, R 89, 6 PM Section 34: <br />i). E /2SW /4 is listed in the text but not in Drawing D -3 -21. <br />ii). Parcels E /2NW /4 and SE /4 are within the permit boundary on the map but not listed in <br />the text. <br />b) T 8, R 89, 6 PM Section 35: <br />i). S /2NW /4NW /4 is listed in the text but not in Drawing D -3 -21. <br />SW /4NE /4NW /4 is listed in the text but not in Drawing D -3 -21. <br />W /2SE /4NW /4 should be W /2W /2SE /4NW /4. <br />iv). The SW parcel is not listed in the description and is part of the permit. <br />c) T 9, R 89, 6 PM Section 2: <br />i). The two parcel descriptions are overlapping and very vague.
