The first parcel is described as E/2 which means the entire eastern half of the section. <br />The Drawing does not reflect this description. Please amend the parcel description. <br />The scale on proposed Drawing D -3 -2 is F =100'. The currently approved Drawing D -3 -2 in the <br />permit is 1" =200'. Please verify the scale on the submitted map is correct. <br />6. TR -28 proposes to add a ditch and refuse pond to the developed water resource. The current <br />developed water resource is listed as having 4.10 acres of disturbance and 411.0 affected acres. <br />The application form adds 7.5 acres to the permitted acres but does not add area to disturbed or <br />affected acres. Please amend the `change in acres' section of the application form and Drawing <br />D -3 -2 to include the additional ditch and refuse pond as part of the developed water resource. <br />7. The refuse pond was once included in the permit boundary, approved as a permanent structure <br />and bond released from the permit in SL -6. The refuse pond is currently well vegetated and the <br />embankment appears to be stable as designed. Incorporating the refuse pond back into the permit <br />boundary and using it for water storage as designed will not require any new surface disturbance <br />or reclamation. The ditch and pond will be subject to the bond release procedures of Rule <br />3.03.1(5). The Division is satisfied that the current bond held for the disturbance area associated <br />with the developed water resource is adequate to cover the addition of the refuse pond. <br />Minrec has a contract with the current land owner for the right of entry.
