Name of Addressee
Page 3
Date
description accuracy for this section.
d) T 9, R 89, 6 PM Section 3:
i). The first parcel is described as E/2 which means the entire eastern half of the section.
The Drawing does not reflect this description. Please amend the parcel description.
The scale on proposed Drawing D -3 -2 is F =100'. The currently approved Drawing D -3 -2 in the
permit is 1" =200'. Please verify the scale on the submitted map is correct.
6. TR -28 proposes to add a ditch and refuse pond to the developed water resource. The current
developed water resource is listed as having 4.10 acres of disturbance and 411.0 affected acres.
The application form adds 7.5 acres to the permitted acres but does not add area to disturbed or
affected acres. Please amend the `change in acres' section of the application form and Drawing
D -3 -2 to include the additional ditch and refuse pond as part of the developed water resource.
7. The refuse pond was once included in the permit boundary, approved as a permanent structure
and bond released from the permit in SL -6. The refuse pond is currently well vegetated and the
embankment appears to be stable as designed. Incorporating the refuse pond back into the permit
boundary and using it for water storage as designed will not require any new surface disturbance
or reclamation. The ditch and pond will be subject to the bond release procedures of Rule
3.03.1(5). The Division is satisfied that the current bond held for the disturbance area associated
with the developed water resource is adequate to cover the addition of the refuse pond.
Minrec has a contract with the current land owner for the right of entry. Please verify that the
incorporation of the refuse pond back into the permit boundary is within the terms of the
landowner contract.
Please contact me if you have any question.
Sincerely,
Brock Bowles
Environmental Protection Specialist
brock.bowles @state.co.us
