This response addresses the questions raised by the Division in its June <br />10, 2014 letter. <br />In the Division's June 10, 2014 letter, questions were raised about the mine discharge meeting effluent <br />limitations before leaving the permit boundary. Minrec's response to these questions is to expand the <br />permit boundary to include an additional pond, therefore containing all the discharge water within the <br />permit boundary. The Division determined that the permit boundary expansion of 7.5 acres can be done <br />as an incidental boundary change under the current TR -28. The operator was required to re- publish the <br />TR -28 public notice with the permit boundary change announcement. <br />The Division has the following comments: <br />Rule 4.05.2(1) requires discharge from underground workings to meet the effluent limitations of <br />Rule 4.05.2 before leaving the permit area. Please provide a revised CDPS permit or <br />acknowledgement from the Water Quality Control Division (WQCD) of the spillway <br />reconfiguration. <br />DRMS: The addition of the refuse pond will increase the holding capacity of water within the <br />permit boundary which will decrease the likeliness of water discharging to North Thompson <br />Creek. The refuse pond is also down gradient from the currently approved discharge point.
