The owner of the buried water line has been identified as L.G. Everist, Inc. and the water <br />line and owner information has been added to Exhibits C -1, Existing Conditions Map, <br />Exhibit C -4, Pre- Mining/Mining Plan Map, and Exhibit F, Reclamation Plan Map. The <br />revised exhibits are attached. L.G. Everist has been notified about the proposed Connell <br />Carr Pit operations and the applicant is pursuing a structure agreement. Until a structure <br />agreement is provided to the Division, mining will remain three (3) times the pit depth <br />from the structure. <br />8. At this time, mining is not anticipated in the southwest corner of the permit area since the <br />material is primarily overburden and soils. However, the area has been included in the <br />permit area and mining limits in case additional overburden is needed for product mixing <br />and /or reclamation activities. <br />6.4.4 Exhibit D — Mining Plan <br />9. The Applicant will operate the site as a continuous operation and not an "intermittent <br />operation ". If, at some time in the future, the Connell Carr Pit fits the definition of an <br />"intermittent operation ", the Division will be notified. <br />10. Topsoil depth is approximately 0" — 6" across most of the site. Overburden material <br />depths range from 0 to 6 feet across the Connell Carr Pit site. All available topsoil will <br />be used for reclamation. Associated clarification has been added to Exhibit D, Mining <br />Plan, attached. <br />11. Prior to establishing a Lone Tree Creek temporary crossing for mining in Phase II, the <br />Applicant shall obtain necessary permits from the Army Corps of Engineers. Copies of <br />the permits will be sent to the Division. <br />12. The minimum setback from the mine pit top of slope and the permit boundary or man- <br />made structures not owned by the Applicant shall be at least 50 feet. The associated <br />changes have been made to Exhibit C, Pre - Mining /Mining Plan Map, Exhibit D, Mining <br />Plan, and Exhibit F, Reclamation Plan Map, attached. <br />13. To mitigate stability risks adjacent to man -made structures not owned by the Applicant, <br />the mine pit top of slope setback to man -made structures shall be 50 feet or three (3) <br />times the pit depth, whichever is greatest. If no man -made structure is present, the mine <br />pit top of slope setback to the permit boundary shall be 50 feet or two (2) times the pit <br />depth, whichever is greatest. <br />14. Mine pit side slopes shall be reclaimed at 3H:1 V or flatter. The associated changes have <br />been made to Exhibit C, Pre- Mining/Mining Plan Map, Exhibit D, Mining Plan, <br />Exhibit E, Reclamation Plan, Exhibit F, Reclamation Plan Map, and Exhibit L, <br />Reclamation Costs, attached. <br />Page 2 of 4 <br />
