The information and discussion below addresses each <br />comment as it was presented by the Division: <br />1. Proof of publication in newspaper is attached. <br />2. Proof of notice to all owners of record of surface and mineral rights of affected land and <br />surface owners and easement holders within 200 feet of the affected land is attached. <br />3. The Army Corps of Engineers comments have been reviewed and it is anticipated that no <br />jurisdictional wetlands will be affected by Phase I of the mining operation as described in <br />the application. Prior to mining in Phase II, the Army Corps of Engineers will be <br />contacted and required permits will be obtained to cross Lone Tree Creek jurisdictional <br />waters of the U.S. <br />6.4.1 Exhibit A — Legal Description <br />4. The latitude and longitude of the main site entrance stated in Exhibit A is correct (40° 53' <br />58.1" N, 104° 53' 26.0" W). The revised application form is attached. <br />6.4.3 Exhibit C — Pre - Mining and Mining Plan Maps of Affected Land <br />5. The parcel record number for the proposed mine site landowner (Record <br />No. 020121000002) has been corrected on the revised Exhibit C -1, Existing Conditions <br />Map, attached. <br />6. Terry Grazing Association is the landowner of the property to be mined. The parcel has <br />been leased as part of the Public Access Program, an interagency agreement between the <br />State Board of Land Commissioners and Colorado Parks and Wildlife.
