Mr. Peter Hays <br />RE: Connell Carr Pit M -2014 -001 <br />April 7, 2014 <br />6.4.5 Exhibit E — Reclamation Plan <br />15. Mine pit side slopes shall be reclaimed at 3H:1 V or flatter. The associated changes have <br />been made to Exhibit C, Pre- Mining/Mining Plan Map, Exhibit D, Mining Plan, <br />Exhibit E, Reclamation Plan, Exhibit F, Reclamation Plan Map, and Exhibit L, <br />Reclamation Costs, attached. <br />16. An updated reclamation seed mix has been obtained from the local Natural Resource <br />Conservation Service office (see attached reference document). The associated changes <br />have been made to Exhibit E, Reclamation Plan and Exhibit F, Reclamation Plan Map, <br />attached. <br />6.4.12 Exhibit L — Reclamation Costs <br />17. The applicant has revised reclamation costs based on reclaimed 3H:1 V slide slopes. The <br />associated changes have been made to Exhibit L, Reclamation Costs, attached. <br />6.4.14 Exhibit N — Source of Legal Right to Enter <br />18. In the original application, the second and third pages of the lease agreement were <br />mistakenly excluded. Terry Grazing Association and JRT Limited Partnership are <br />associated business entities with mutual interest in the property. The full lease agreement <br />with all interested party signatures is attached. Additionally, a recent amendment to the <br />original lease agreement is attached. <br />19. The Weld County Assessor's records list Terry Grazing Association as the surface owner <br />of the proposed permit property. Additionally, Schedule A of the Title Commitment <br />performed for the property is attached. <br />6.4.18 Exhibit R — Proof of Filing with County Clerk and Recorder <br />20. The date stamped "proof of delivery" transmittal letter for these adequacy review <br />comment responses to the Weld County Clerk to the Board is attached. <br />6.4.19 Exhibit S — Permanent Man -Made Structures <br />Based on the proposed mining setbacks, we do not believe that mining and reclamation activities, <br />as described in the application and adequacy review responses, will adversely affect the stability <br />of any significant, valuable and permanent man -made structure not owned by the applicant. <br />21. With the mining pit top of bank setback a minimum of 50 feet or three (3) times the <br />adjacent pit depth from permanent man -made structures, the applicant believes that we <br />have complied with the provisions of Rule 6.4.19. Regardless of the negligible stability <br />concerns for adjacent man -made structures due to the proposed setbacks, the Applicant <br />has been discussing the proposed mining and reclamation operation with owners of <br />adjacent man -made structures, including all adjacent utility owners.
