Cazier, P.E. <br />February 24, 2014 <br />Page 5 <br />12) Comment: Beginning about September 2012, several wells (MW -14, MW -14R, MW -13, <br />MW -13R & one of the three indistinguishable wells described in Item 4b) have water <br />levels that have dropped approximately 10 feet. The Division considers this a significant <br />impact to the prevailing hydrologic balance pursuant to Rule 3.1.6(1). Please describe <br />measures being implemented and /or considered to mitigate this impact on surrounding <br />well owners. <br />Response: Transit Mix has implemented a ground water monitoring program to <br />identify declining water levels near the mining area, allowing Transit Mix to take <br />appropriate steps to mitigate potential water supply impacts before they occur. As <br />shown in Tables 1 and 2, Transit Mix has taken several measures, as necessary, to <br />mitigate potential water supply impacts. These measures include constructing <br />new wells, installing new cisterns and/or providing hauled water to residents near <br />Phases 2 and 7. A list of the measures taken to mitigate well impacts can be <br />found on Tables 1 and 2. In addition, Transit Mix has met with the neighboring <br />well owners and ensured that reliable points of contact are available if problems <br />occur. Transit Mix has maintained communication with the neighboring land <br />owners. <br />13) Table 1 / Exhibit C -8. Comment: Six of the 12 listed well users (Stratman, Sabec, <br />Hardy, Lopez, Linsenmann, and Arrow Electric) indicate no water supply improvements. <br />Please explain why no improvements have occurred. The response should include a <br />summary status of any negotiations, summary of any agreements in place, and reasons <br />why improvements are not necessary or wanted. Also, please indicate whether there are <br />any signed agreements with the well users for which water supply improvements have <br />been made. <br />a. Response: The six well users listed above have not received water supply <br />improvements yet because the conditions in their respective wells have not yet <br />indicated that improvements are necessary. Individual well users are provided <br />water supply improvements by Transit Mix if it appears that the operation of a <br />given well is going to be impacted by declining ground water levels as a result of <br />Phase 7 mining. As indicated in the revised Table 1 attached, agreements were <br />signed by well owners located within 600 -feet of the mining boundary prior to <br />Phase 7 mining, ensuring residents that a no cost alternative water supply would <br />be provided should their well be impacted. In addition, Transit Mix has provided <br />water supply improvements, as necessary, to other residents beyond 600 -feet of <br />the mining boundary as well. <br />To forecast whether a well would be impacted, prior to mining in Phase 7 Transit <br />Mix implemented a ground water monitoring program. With permission from <br />well owners, Transit Mix additionally gathers water level data from individual <br />residential wells. Action is taken when only a few feet of water above the well <br />pumps remain.
