Memo to PCPC <br /> Re: SUP No. 1999-002 <br /> June 9, 1999 <br /> Page 23 <br /> Following is a list of those findings in bold face print, with staff comments <br /> indented thereafter. <br /> (a) The requested use is a use listed as a special permitted use in the <br /> district in which the parcel is located. <br /> Staff: The Pueblo County Zoning Resolution provides that "Natural Deposits, <br /> Extraction, and Processing" is a use-by-review in an A-1, Agricultural (minimum <br /> 40 acre) Zone District. <br /> (b) The granting of the special use appeal will not substantially modify <br /> the land use plan or the intent, purpose and spirit of this resolution. <br /> This special use permit does not significantly modify the land use plan. <br /> According to the Zoning Resolution, the spirit and purpose of the A-1 Zone <br /> District is "to retain and promote the appropriate use of dry range and irrigated <br /> lands and encourage open use of the land in keeping with its natural <br /> characteristics and agricultural functions." This extraction activity is considered <br /> "temporary" and provides for a sequential use of the land by allowing mineral <br /> extraction to be followed by some other use, be it agricultural, residential, or <br /> other. <br /> This special use permit is generally consistent with that intent. The concept of <br /> zoning underlying "special Use' or "uses-by-review" is that such uses are not <br /> inherently inconsistent with the "principal uses" or "uses-by-review" of the zone <br /> district. However, a specific use-by-review may not be appropriate at all <br /> locations throughout the zone district. Therefore, the Planning Commission is <br /> given the opportunity to consider the compatibility of the use with surrounding <br /> uses. The Commission may also impose reasonable conditions to ensure <br /> consistency with the character of the area and to minimize impacts. <br /> (c) This special use proposal incorporates reasonable means to create <br /> an environment harmonious with that of the surrounding properties. <br /> Staff: The surrounding land use is primarily open range with other mining <br /> operations and Comanche Power Plant northeasterly of the site, the CF&I <br /> industrial complex to the north, and open range to the south and east. The <br /> Quarry Plan identifies mitigation measures for controlling fugitive emissions. The <br /> mining area will be reclaimed concurrently with mining so that the actual <br /> disturbed area will be approximately 30t acres at any given time. The <br />
