Memo
Date: 22June 11
From: R.L. Gubka
To: File
Conversation between Buckshot Burbridge and Ross Gubka Concerning the Storm Water
Collection Ditches, water share deliveries, Pipelines and Depressions
Items of Discussion.
I met Buckshot in the southern portion of Ward Burbridge's fields this morning.
Buckshot was in the process of cutting the first cutting of hay in Ward's field. I asked
Buckshot if the Burbridge family would want to keep the big Storm Water Collection
Ditch (southern portion of property) that WFC had put in years ago to control storm
water from the reclaimed fields. I said that WFC believed we were in a position of
removing them, or leaving them if the land owner wished. That WFC had fulfilled the
requirements from DRMS in the reclamation and the perimeter ditch was no longer
needed. Buckshot said they wanted them removed. I said that WFC would need a letter
from Ward, since he is the land owner, stating the Burbridge's wishes. Buckshot said he
would discuss it over with his dad and get the letter. After further discussion, Buckshot
did say that he thought the ditch should be removed, but, the surface water running off
the fields should be directed to one of three culverts that goes under the 5`h Rd that is
immediate adjacent to the field. I said WFC could do that. Then Buckshot said that he
would like a tailwater ditch along the southern edge to help collect the irrigation water.
Something like 2ft wide by 2ft deep. I said we could do that too. We then discussed the
ditch that runs north -south along the east ROW fence of 27Rd. Buckshot said they would
like to keep that ditch so they could get the runoff water from the WFC /Garvey fields and
have that water run into Pond 008. Buckshot would like the area between the ditch and
the fence line cleaned up some, so he could get a tractor over there for fence
maintenance. I said I didn't think that would be a problem. Buckshot asked about the
temporary 4inch HDPE pipeline that is presently there, could they keep it. I said I didn't
think that would be a problem. I asked if it would be OK to just leave it on the surface as
it is now. He said sure. We discussed legal easements for both the 4inch HDPE line and
the I Oinch PVC line on the other side of the property. I said WFC would draw up, file
and do whatever it took to make a legal document giving the Burbridge the ROW to get
their water across the WFC /Garvey parcels to the Burbridge property. Buckshot was
good with this.
Buckshot has concerned about the water rights of the water within Pond 008. I told him I
was unsure of that issue and would have to get back with him on that. Buckshots concern
and desires was to be able to fill the pond up with stock water for his livestock during the
{00056962.11
