The Tie - Across Haul Road (TAHR) was designed and constructed during 1989 in <br />preparation for coal haulage in 1990 from the Seneca II -W Mine area to the Hayden Station <br />Power Plant. The TAHR was originally approved as part of the Seneca II -W Permit No. C- <br />1982 -057 and was transferred to Hayden Gulch as part of PR -01 (approved January 2012). <br />Once again the reclamation bond was increased to include the TAHR. <br />In 2011 HGL reclaimed the proposed loading/unloading facility area. The reclamation <br />activities included removal of all tipple and coal handling structures, elimination of the <br />remains of surface coal piles, and reconfiguring the area (including finish grading, topsoil <br />replacement and seeding of 11.9 acres). Following the reclamation activities, HGL applied <br />for Phase I bond release on the 11.9 acres. <br />HGL filed an application (SL -1) for Phase I bond release on February 2, 2012 requesting <br />release of $488,408 on 11.9 acres. On July 27, 2012, the Division approved the release of <br />$353,829.24 on the 11.9 acres of reclamation. Exhibit 12 -1, Hayden Gulch, Tie - Across <br />Haulroad Facilities, shows the current configuration of the HGL permit area following the <br />SL -1 bond release. <br />Permit Renewal RN -3 expires on May 22, 2013 and HGT submitted an application (RN -4) to <br />extend the permit for another five years. The future operations /reclamation plans for the <br />Hayden Gulch Loadout permit area during the next five year permit term will be based on <br />future economic and political conditions. No future operational or reclamation scheduling <br />can be developed at this time. <br />PERMIT RENEWAL (RN -4) EXISTING STATUS /CONDITIONS <br />This section updates the current status and condition of the HGT permit area facilities at the <br />time of permit renewal (RN -4). <br />Sediment and Water Control Facilities Plan <br />There are two sedimentation ponds located within the permit boundary. The ponds were <br />originally designed and constructed by Morrison - Knudson Company in May 1980 for the <br />previous operator / permittee, H -G Coal Company. The ponds have been referred to as "Truck <br />Loop Pond 1 (Pond A, Outfall 006)" and "Rail Loop Pond 2 (Pond B, Outfall 007) ". HGT <br />identifies the ponds as "Truck Loop Pond" and "Rail Loop Pond" — the ponds are permitted <br />by the Colorado Water Quality Control Division as industrial wastewater treatment facilities <br />under Permit No. COG - 850008. Exhibit 12 -2 shows locations and contributing drainage <br />areas for both ponds. <br />The Rail Loop Pond was modified in 1985. A permit revision was submitted (by previous <br />operator /permittee) to replace the culvert spillway with a trapezoidal spillway constructed of <br />fabriform. Certification reports for this pond modification are presented in Appendix 12 -1A, <br />Pond Certifications. <br />The Truck Loop Pond was modified by the previous operator /owner in June 1992. This <br />modification was performed to meet CDRMS regulations regarding separate pipe spillways. <br />TR -10 2 Revised 02/13 <br />
