The Division may require more frequent inspection based <br />upon an evaluation, of the potential danger to the health or safety of the public and the <br />potential harm to land, air and water resources. Inspections may terminate when the <br />coal mine waste bank has been graded, covered in accordance with 4.10.4(5), topsoil <br />has been distributed on the bank in accordance with 4.06.4, and revegetated, or at such <br />a later time as the Division may require. <br />(b) Inspections shall include such observations and tests as may be necessary to evaluate <br />the potential hazard to human life and property, to ensure that all organic material and <br />topsoil have been removed and that proper construction and maintenance are occurring <br />in accordance with the plan submitted under 2.05.3(8) and approved by the Division. <br />(c) The engineer or other approved inspector shall consider steepness of slopes, seepage, <br />and other visible factors which could indicate potential failure, and the results of <br />failure with respect to the threat to human life and property. <br />(d) Copies of the inspection findings shall be maintained at the mine site. <br />(3) If any inspection discloses that a potential hazard exists, the Division shall be informed <br />promptly of the finding and of the emergency procedures formulated for public protection <br />and remedial action. If adequate procedures cannot be formulated or implemented, the <br />Division shall be notified immediately. The Division shall then notify the appropriate <br />emergency agencies that other emergency procedures are required to protect the public <br />from the coal mine waste area. <br />4.10.3 Water Control Measures <br />(1) A properly designed subdrainage system shall be provided, in accordance with the <br />following except where alternative specifications are used in accordance with 4.10.3(5). <br />Each system shall: <br />(a) Intercept all ground water sources; <br />(b) Be protected by an adequate filter; and <br />(c) Be covered so as to protect against the entrance of surface water or leachate from the <br />coal processing waste. <br />(2) All surface drainage from the area above the coal mine waste bank and from the crest and <br />face of the waste disposal area shall be diverted in accordance with 4.09.2(7). <br />1. Diversion of uphill flow is not clearly addressed in this application. Existing "Reach <br />6" may be interpreted to accomplish this purpose, but its exact location and design <br />details should be incorporated into the design for the West Waste Bank. Please revise <br />the design for the West Waste Bank to address 100 yr 24 -hr diversion of all upland <br />flow away from the waste bank. <br />
