All disturbed <br />areas, including diversion ditches that are not riprapped, shall be vegetated upon completion <br />of construction. <br />(4) All water discharged from a coal mine waste bank shall comply with the relevant <br />Subsections of 4.05. <br />(5) An alternative subdrainage system may be utilized after approval by the Division upon a <br />thorough analytical demonstration that such an alternative will ensure the applicable static <br />safety factor, stability of the fill and protection of the surface and groundwater in <br />accordance with the requirements of these Rules. <br />4.14.4 Construction Requirements <br />(1) Coal mine waste banks shall be constructed in compliance with 4.09.1, except to the extent <br />that the requirements of those Subsections are varied in 4.10.4. <br />(2) Coal mine waste banks shall have a minimum static safety factor of 1.5. <br />(3) Compaction requirements during construction or modification of all coal mine waste banks <br />shall be: <br />(a) Spread in layers no more than 24 inches in thickness; <br />(b) Compacted to attain 90 percent of the maximum dry density to prevent spontaneous <br />combustion and to provide the strength required for stability of the coal mine waste <br />bank. Dry densities shall be determined in accordance with the American Association <br />of State Highway and Transportation Officials (AASHTO) Specifications T99 -74 <br />(Twelfth Edition)(July 1978) or an equivalent method. AASHTO T99 -74 is hereby <br />incorporated by reference as it exists on the date of adoption of 4.10. This publication <br />is on file and available for inspection at the office of the Division; and <br />(4) In no case shall the slope of a terrace on a coal mine waste bank be steeper than 2h:ly (50 <br />percent). <br />(5) Following grading of the coal mine waste bank, the site shall be covered with a minimum <br />of 4 feet of the best available non -toxic and non - combustible material, in accordance with <br />4.06.2, and in a manner that does not impede flow from subdrainage systems. The coal <br />mine waste bank shall be revegetated in accordance with 4.15. The Division may allow <br />less than 4 feet of cover material based on physical and chemical analyses which show that <br />the requirements of 4.15 will be met. <br />4.11.4 Disposal of Noneoal Waste <br />(3) At no time shall any noncoal mine waste be deposited in a refuse pile. <br />
