[The West Waste Bank is not a Valley Fill configuration, so much of <br />this section is not applicable.] <br />(3) [See 4.10.4(3)] <br />(4) [See 4.09.1(8)] <br />(5) Drainage shall not be directed over the outslope of the fill. <br />(6) [See 4.10.4(4)] <br />(7) [See also 4.09.1(5) and 4.10.3(2)] Surface water runoff from the area above the fill shall be <br />diverted away from the fill and into stabilized diversion channels designed to pass safely <br />the runoff from a 100 -year, 24 -hour precipitation event or larger event specified by the <br />Division. Surface runoff from the fill surface shall be diverted to stabilized channels off the <br />fill which will safely pass the runoff from a 100 -year, 24 -hour precipitation event. <br />Diversion design shall comply with the requirements of 4.05.4. <br />4.10.1 General Requirements <br />(1) All coal mine waste shall be transported and placed in new and existing disposal areas <br />approved by the Division for this purpose. These areas shall be within a permit area. The <br />disposal area shall be designed, constructed, inspected and maintained: <br />(a) In accordance with 4.09.1, 4.09.2, 4.10, and 4.11; and <br />(b) To prevent combustion. <br />(2) Coal mine waste materials from activities located outside a permit area, such as those <br />activities at other mines or abandoned mine waste piles may be disposed of in the permit <br />area only if approved by the Division. (None requested.) <br />4.10.2 Site Inspection <br />(1) All coal mine waste banks shall be inspected, on behalf of the person conducting surface <br />coal mining operations by a qualified registered engineer, or other qualified professional <br />specialist under the direction of the professional engineer, experienced in construction of <br />similar earth and waste structures, approved by the Division. <br />(2) Inspection of coal mine waste banks shall be performed in accordance with rule 4.09.1(11), <br />and the following additional requirements: <br />
