Please commit to providing the trigger level elevations established from a 2 -foot change from historical groundwater levels, for each monitoring locations with the groundwater data submitted with the annual report. The revision states Mr. Don Loloff is pursuing agreements with the existing well owners within 600 feet of the mining limit of the pit. Please provide the Division with signed copies of the agreements when available or provide evidence the appropriate notice was provided to the well owners. The Operators response stated the agreements that have been obtained were attached. The other agreements are being negotiated and certified mail was sent to Kohloff and Taylor. a) Please provide the Division with signed agreements or proof of certified mailing to Kohloff and Taylor. b) Please provide the Division with signed agreements or proof of certified mailing for the remaining well owners within 600 feet of the Loloff Mine as listed in Exhibit G: a. Hoshiko Farms —Permit #12332 b. Midexco Construction —Permit #134824 c. Varra Companies — Permit #75965 d. Aggregate Industries — Permit #63551 c) Exhibit G lists two wells owned by Robert D. Francis, Permits #27480 and #135883; however the agreement lists three wells, Permits #30562, #135883, and #26555A. Please explain this discrepancy. d) The agreement between Monroe and Loloff Construction is difficult to read. Please submit a legible copy. Response: a) The agreement with Kohloff is attached. The agreement with Taylor was sent certified mail (see list of certified mail receipts). b) An agreement with Hoshiko Farms was not obtained because the well is not within 600 feet and Hoshiko Farms removed their objection to the well permit that was provided with the last submittal (a letter agreement for mining within 200 feet of the Hoshiko Farms property was sent certified mail). An agreement with Midexco Construction was not obtained as there is not an address that could be found to send the agreement to and a physical location of the well was not found within 600 feet of the pit.
