The response is adequate. Please commit to providing the trigger level <br />elevations established from a 2 -foot change from historical groundwater <br />levels, for each monitoring locations with the groundwater data submitted with <br />the annual report. <br />Response: <br />The Operator commits to providing the trigger level elevations from a 2 -foot change <br />from historical ground water levels for each monitoring location with the groundwater <br />data submitted with the annual report. <br />17. The revision states Mr. Don Loloff is pursuing agreements with the existing <br />well owners within 600 feet of the mining limit of the pit. Please provide the <br />Division with signed copies of the agreements when available or provide <br />evidence the appropriate notice was provided to the well owners. <br />The Operators response stated the agreements that have been obtained were <br />attached. The other agreements are being negotiated and certified mail was <br />sent to Kohloff and Taylor. <br />a) Please provide the Division with signed agreements or proof of certified <br />mailing to Kohloff and Taylor. <br />b) Please provide the Division with signed agreements or proof of certified <br />mailing for the remaining well owners within 600 feet of the Loloff Mine as <br />listed in Exhibit G: <br />a. Hoshiko Farms —Permit #12332 <br />b. Midexco Construction —Permit #134824 <br />c. Varra Companies — Permit #75965 <br />d. Aggregate Industries — Permit #63551 <br />c) Exhibit G lists two wells owned by Robert D. Francis, Permits #27480 and <br />#135883; however the agreement lists three wells, Permits #30562, #135883, <br />and #26555A. Please explain this discrepancy. <br />d) The agreement between Monroe and Loloff Construction is difficult to read. <br />Please submit a legible copy. <br />Response: <br />a) The agreement with Kohloff is attached. The agreement with Taylor was sent <br />certified mail (see list of certified mail receipts). <br />b) An agreement with Hoshiko Farms was not obtained because the well is not <br />within 600 feet and Hoshiko Farms removed their objection to the well permit that <br />was provided with the last submittal (a letter agreement for mining within 200 feet <br />of the Hoshiko Farms property was sent certified mail). An agreement with <br />Midexco Construction was not obtained as there is not an address that could be <br />found to send the agreement to and a physical location of the well was not found <br />within 600 feet of the pit.
