10/15/13 State.co.us Executive Branch Mail -Re: Southfield Mine: MWNW & Pond 4 <br />will also detail our opinion regarding Pond 4 and additionally address our thoughts on all of <br />the existing wells on <br />our property. <br />MWNW: <br />In the report conducted by the Colorado Division of Minerals and Geology, Ronald W. <br />Cattany, Director and James R. Stark, Environmental Protection Specialist : Findings of <br />Compliance and Proposed Decision for a Phase 1 Bond Release and Bond Reduction SL- <br />02 for Energy Fuels Coal, Inc.. Southfield Mine, Permit No. C -81 -014 <br />please refer to the Section: Sealing of Underground Mine Openings- Portals, Fans, Vent <br />Shafts and Monitoring Wells and specifically pagel6 which states: <br />"None of the five monitoring wells within the Southfield permit area have been <br />sealed at this time. All are required for ongoing hydrologic monitoring of the <br />groundwater. The Division has also requested that EFCI leave the North Dewatering <br />Well open to monitor water inflows into the mine and to monitor water quality in the <br />mine." <br />From the Colorado Division of Minerals and Geology :GUIDLINE REGARDING SELECTED <br />COAL MINE BOND RELEASE ISSUES: <br />"The Phase 111 bond release application must include a detailed water quantity and <br />quality impact analysis to assess compliance with 4.05. This analysis will provide a <br />summary of existing surface and groundwater data for the mine and adjacent areas. <br />Adequate monitoring facilities must remain in place and functional through the bond <br />liability period to ensure that this requirement can be met." <br />Further, <br />"Accordingly, impact analysis will focus on trends which would support or refute <br />long -term stability in quantity and quality data.
