The concentration set forth in subparagraph a, <br />above, was in excess of the 30 mg/l set forth <br />~ln the 1979 permit, <br /> <br />c. Each reported exception (beyond one exception) <br />set forth in subparagraph a, above, represents a <br />7-day average BOD concentration in excess of the <br />30 mg/l concentration set forth in the 1979 permit. <br /> <br />d. Each reported concentration and exception <br />(beyond one exception) set forth in subparagraph <br />a, above, constitutes a violation of the 7-day <br />average BOD parameter of Metro's 1979 permit. <br /> <br />e. Such violations total 8 in number. <br /> <br />3. <br /> <br />a. For the months set forth below, as evidenced <br />by Metro's DMRs, Metro discharged the following <br />concentrations of TSS (reported as 3D-day <br />averages) to the South Platte River: <br /> <br />(1) 21 mg/l for January 1982 (Exhibit 1982-1). <br />(2) 27 mg/l for February 1982 (Exhibit 1982-2). <br />(3) 24 mg/l for March 1983 (Exhibit 1983-3) . <br />(4) 23 mg/l for March 1984 (Exhibit 1984-3) . <br />(5) 21 mg/l for November 1984 (Exhibit <br /> 1984-11) . <br />(6) 21 mg/l for November 1985 (Exhibit <br /> 1985-11) . <br /> <br />b. Each reported concentration set forth in <br />subparagraph a, above, was in excess of <br />the 20 mg/l concentration set forth in <br />the 1979 permit. <br /> <br />c. Each such reported concentration set forth <br />in subparagraph a, above, constitutes a <br />violation of the 30-day average TSS parameter <br />set forth in the 1979 permit. <br /> <br />d.
