Each reported exception (beyond one exception)
set forth in subparagraph a, above, represents a
7-day average BOD concentration in excess of the
30 mg/l concentration set forth in the 1979 permit.

d. Each reported concentration and exception
(beyond one exception) set forth in subparagraph
a, above, constitutes a violation of the 7-day
average BOD parameter of Metro's 1979 permit.

e. Such violations total 8 in number.

3.

a. Each reported concentration set forth in
subparagraph a, above, was in excess of
the 20 mg/l concentration set forth in
the 1979 permit.

c. Each such reported concentration set forth
in subparagraph a, above, constitutes a
violation of the 30-day average TSS parameter
set forth in the 1979 permit.

d.
