~!:'W...

'f-~' _ ,;>-<-- ,c.(~

\'f.

.

-55-
Lower Platte and Beaver Canal until his resignation this year.
Gi1frey allegedly has books and tables which show the various
shrink factors in the Lower Platte and Beaver Canal and the shrink
on running various reservoir rights.
We had learned that 16-1/6 Jackson Lake rights were apparent1~
leased out by the Lower Platte and Beaver Canal Company, during
the summer of 1966, to farmers under the Weldon Valley Ditch. We
therefore showed stratton the water order, signed "Lower Platte
and Beaver Canal by Gill," and asked him if he knew anything about
that. He was outraged at seeing this and indicated that this was
entirely contrary to company policy. He stated that we should
contact Major Gi1frey, since only Gi1frey or Gill would be en-
titled to sign such a water order. Stratton stated that Gilfrey
almost certainly would know about the 16-1/6 shares of Jackson
Lake water which supposedly went to the Weldon Valley Ditch. He
doubted very much that this was Lower Platte and Beaver water and
further doubted that the company would ever have sold company water
to the Weldon Valley Ditch. He was very irritated by the thought,
since it had been alleged that the company was so short of reser-
voir water, that it was very difficult to deliver to his lateral
at the end of the Lower Platte and Beaver Canal. Such a sale
would make it even more difficult for him to ever participate in
"company-owned" reservoir water. He stated that he was certain
that none of the stockholders ever authorized such a deal, and
he was also certain that none of the members of the Board of
Directors whom he knows would ever have participated in such a
project. (Despite repeated efforts we were unable to contact
Gilfrey) .

,

'.

.

.

.

.

WOODWARD-CLYDE.SHERARD AND ASSOCIATES
