"'~

f

-53:"

"

also own many "private rights" in various reservoirs.

The Lower Platte and Beaver Canal Company own 29 "private

rights" in Jackson Lake Reservoir and individual farmers under

the Lower Platte and Beaver Canal own an additional 51 "private

rights" in Jackson Lake Reservoir, for a total of 80 rights. In

addition, the Hi11rose Irrigation District owns 194-1/2 "Private

rights" in Jackson Lake'Reservoir which are supposed to be used

each year for the benefit of farmers under the Lower Platte and

Beaver Canal.

According to John Amen, the Lower Platte and Beaver Canal

Company leases out all of its company-held Jackson Lake rights

as well as a few individually held rights each year. It also

leases out Riverside rights which it owns. (Interview, John

Amen, 2/7/67).

Scott Stratton told us that before the mass influx of pumps,

the policy was to hold "company" reservoir water in reserve and

use it to finish runs through the canal so that everyone under

the canal would get his complete water in rotation. However, dur-

ing the last three years Stratton has had only two runs of

Lower Platte and Beaver "reservoir" water.

Stratton said that during the last few years whenever "com-

pany" reservoir rights have been run in the Lower Platte and

Beaver Canal he has been unable to get any water. He attributes

this to prior diversions and seepage in the canal before it gets

to his farm which is located at the lower end of the canal. Never-

theless, he still has to pay an assessment of $240 per year on
these rights to the Lower Platte and Beaver Canal Company. It is
because he has received only two runs of Lower Platte and Beaver

,

WOODWARD.CLYDE.SHERARD AND ASSOCIATES
