<br />, ' <br /> <br />" <br /> <br />-51- <br />their proper share of water whenever water is running in the ditch. <br />If they do not take it they lose it. <br />The company does not permit seasonal transfers of water from <br />other systems to be made into its system (there are some conflict- <br />ing stories on this) and does not allow water rights in its system <br />to be transferred outside the system, seasonally or otherwise. <br />Furthermore, it does not permit its farmers to lease Jackson Lake <br />Reservoir rights from farmers under other systems. <br />Seasonal transfers within the system are allowed between <br />farmers under the system through the Superintendent, Lindy Crumb1el <br />and do not appear anywhere on the records of the company. <br />The company owns more than 3/5 of the outstanding stock (and <br />hence water rights) in the Jackson Lake Reservoir Company, and <br />thus controls that company. It is the policy of the company <br />always to run its Jackson Lake Reservoir rights in the Fort Morgan <br />Canal for the benefit of its stockholders and their rights are <br />never leased to others. <br /> <br />, <br /> <br />6. upper Platte and Beaver Canal <br />The upper Platte and Beaver Canal is operated by the upper <br />Platte and Beaver Canal Company, a mutual irrigation company, and <br />is located on the south side of the South Platte River downstream <br />from Fort Morgan. <br />The company owns direct flow decrees from the river and also <br />shares of "reservoir" stock in the Jackson Lake Reservoir Company, <br />the Morgan-Prewitt Reservoir Company, and the Riverside Reservoir <br />and Land Company. In addition, individual farmers under the system <br />own "private rights" in various reservoir companies.
