An Amended
Application was filed on January 27, 1994.

2. That the Water Clerk caused publication of such filing as provided by statute;
that publication costs have been paid; that the time for filing Statements of Opposition
expired on March 31, 1994 to the Amended Application and that Statements of
Opposition were timely filed by Colorado Water Conservation Board and Twin Lakes
Reservoir and Canal Company.

3. That the said Application concerns a plan of augmentation and a water storage
right represented by 0.50 share of stock of the Twin Lakes Reservoir and Canal Company.

4. That the Applicant herein owns one share of stock of the Twin Lakes Reservoir
and Canal Company of which 0.50 share will be assigned to this project which consists of
constructing 70 feet of2" diameter pipe from Echo Creek to the existing Echo Pond to
maintain the pond at a minimum 5 foot depth. The pond receives some water from spring
seepage, and the Echo Creek water will supplement that supply. The pond has a 10 inch
diameter outlet pipe at zero gage with an Armco slide gate for control purposes.
Connecting to this discharge pipe is a 10 inch diameter vertical overflow pipe which will
help to maintain the pond at a 5 foot depth. Discharge from the pond via this pipe will
flow directly into Echo Creek located some 60 feet from the end of the outlet pipe. If for
any reason this pipe should become plugged, a spillway at the southeasterly corner of the
pond will release water so as to protect the dam.

Q.. Q. : \Y\~\c..
