<br />PAGE 4 - WITHDRAWAL APPLICATION <br /> <br />A Wild and Scenic River suitability study will be completed to determine if <br />the South Platte River segment between Elevenmile Reservoir and Cheesman <br />Reservoir should be recommended for addition to the National Wild and <br />Scenic River System. Management of the corridor will retain the <br />appropriate characteristics of the area until the study is completed, a <br />legislative proposal is made to Congress, and Congress acts on the <br />recommendation. (The Pike and San Isabel National Forests and Comanche and <br />Cimarron National Grasslands Land and Resource Management Plan, Part <br />II-Management Situation, pp. 74-75, Attachment B.) <br /> <br />This application and the resulting withdrawal is the only means available <br />to provide the desired protection for the area. <br /> <br />(8) THE EXTENT TO WHICH THE LANDS EMBRACED IN THE APPLICATION ARE REQUESTED TO BE <br />WITHHELD FROM SETTLEMENT, SALE, LOCATION OR ENTRY UNDER THE PUBLIC LAND LAWS, <br />INCLUDING THE MINING LAWS, TOGETHER WITH THE EXTENT TO WHICH, AND THE TIME <br />DURING WHICH, THE LANDS INVOLVED IN THE APPLICATION WOULD BE TEMPORARILY <br />SEGREGATED IN ACCORDANCE WITH 2310.2 OF THIS TITLE. <br /> <br />The application is for a withdrawal from entry under the United States <br />mining laws (30 u.s.c. Ch. 2). <br /> <br />(9) THE TYPE OF TEMPORARY LAND USE THAT, AT THE DISCRETION OF THE AUTHORIZED <br />OFFICER, MAY BE PERMITTED OR ALLOWED DURING THE SEGREGATION PERIOD, IN <br />ACCORDANCE WITH 2310.2 OF THIS TITLE. <br /> <br />Presently authorized uses of National Forest System lands may continue <br />until the Wild and Scenic River Study is completed. If the area is <br />determined to be eligible for inclusion in the Wild and Scenic River <br />System, the lands will be closed to all non-Forest Service uses, except for <br />public access on Forest Development Roads and trails accessing the area. <br /> <br />The area would be managed under the Pike and San Isabel National Forests <br />and Comanche and Cimarron National Grasslands Land and Resource Management <br />Plan, III-Management Requirements, Wild and Scenic River Management, pp. <br />16-17 (Attachment C): <br /> <br />Protect river segments that have been determined eligible for potential <br />addition to the National Wild and Scenic Rivers system from activities <br />which could diminish or change the free-flowing character, water quality, <br />or the scenic, recreational, fish and wildlife, and other values which make <br />the river eligible for designation. <br /> <br />a. Request that Federal lands which constitute the bed or bank, or which <br />are within one-quarter mile of either bank, be temporarily withdrawn <br />from appropriation and entry under the mining laws. Withdrawal should <br />continue until the river segment is: a) found to be ineligible; b) not <br />recommended for inclusion in the National system; or c) added to the <br />system by Act of Congress. <br /> <br />b. Safeguard the values of the river area by appropriate conditions and <br />stipulations in leases, permits, and licenses, including prospecting, <br />issued under terms of the mineral leasing laws. <br /> <br />084< <br />
