<br />PAGE 5 - WITHDRAWAL APPLICATION <br /> <br />c. Extraction of salable, common-variety minerals from the river or the <br />study area shall not be authorized until the study is complete and <br />recommended actions are enacted. <br /> <br />d. Prohibit construction of roads within the river study area if it would <br />have direct adverse effects on the values which make the river eligible <br />for potential inclusion into the system. <br /> <br />e. Maintain current motorized access character and avoid any changes to <br />the potential wild and scenic river classification. <br /> <br />f. Maintain free-flowing characteristics and water quality during the <br />study and Congressional review period. <br /> <br />g. Manage tree stands within the study area to maintain or enhance <br />potential wild and scenic river values. Protect scenic values by <br />sizing and shaping timber harvest units to achieve a natural appearance <br />and to harmonize with the surrounding landscape. <br /> <br />h. Prohibit special uses or permitted land uses which degrade or have <br />directly adverse effects on values which make the river segment <br />eligible. <br /> <br />i. None of this direction shall abrogate any existing privileges or <br />contracts affecting National forest System lands held by any private <br />party without consent of said party. Activities affecting the <br />applicability of U.S. mining and mineral leasing laws are subject to <br />valid existing rights. <br /> <br />(10) AN ANALYSIS AND EXPLANATION Of WHY NEITHER A RIGHT-Of-WAY UNDER SECTION 507 Of <br />THE ACT (43 U.S.C. 1767),NOR A COOPERATIVE AGREEMENT UNDER SECTIONS 302(b) (43 <br />V.S.C. 1732(b)) Of THE ACT WOULD ADEQUATELY PROVIDE FOR THE PROPOSED USE. <br /> <br />Neither a right-of-way nor a cooperative agreement is applicable to Forest <br />Service use of National forest System lands. The withdrawal is needed to <br />protect the unique resources from appropriation under the mining laws. <br /> <br />(11) THE DURATION OF THE WITHDRAWAL, WITH A STATEMENT IN JUSTIFICATION THEREOF (SEE <br />2310.3-4 Of THIS TITLE). WHERE AN EXTENSION OF AN EXISTING WITHDRAWAL IS <br />REQUESTED, ITS DURATION HAY NOT EXCEED THE DURATION OF THE EXISTING WITHDRAWAL. <br /> <br />The withdrawal should continue until the river segment is: a) found to be <br />ineligible; b) not recommended for inclusion in the Wild and Scenic River <br />system; or c) added to the System by Act of Congress. <br /> <br />Since a specific duration is required, and past experience indicates that <br />the process for review/inclusion into the system can take in excess of 20 <br />years, the requested duration of the withdrawal is 20 years. <br /> <br />0841 <br />
