By motion made by Mr. Nichols and seconded by Mr. <br />J)ill~y, it was:' ... <br /> <br />RESOLVED, lhatthe District approve House Bill 1260. <br /> <br />House Bill 1066 for the administration of water develope~ by wells was next <br />discussed. It was pointed out that off channel wells would not be affected. <br />Discussion centered primarily upon the grandfather cla~se and upon motion <br />made by Mr. Milenski, the District approved House Bill 1066 provid€d the <br />grandfather clause would be limited to the effective date of the act. Three <br />I'nolsll were recorded, being the votes of Messrs~ Bauserman, Ciruli and <br />Cooper. Subsequently Mr. Cooper elaborated on his position in that in his <br />opinion the engineer presently had authority to do what House Bill 1066 ap:- <br />proved 3.nd that the bill would contribute nothing. <br /> <br />Mr. Boustead pointed out that Senate Bill 93 declaring all waters to be public <br />subject to appropriation had a poor reception and probably would not pass. <br /> <br />Mr. Cooper next presented the current situation with reference to proposed <br />litigation between various ditches in the lower valley and suggested that there <br />were several possible organizatiorElto take the leadership in discussing this <br />problem and to determine the precise points of differences and views between <br />the parties and possible solutions, if any other than litigation; that he had <br />discussed this matter with Mr, Milenski; that it was his thinking that the d~s- <br />trict was more able to assume the responsibility of leadership and to make <br />effective its suggestions than would any other existing organization in the <br />Arkansas Valley, even though the District dO€s not encompass the entire <br />valley. Mr. Milenski stated that he had discussed the ~atter with Mr. <br />Danielson and agreed that the district was the logical entity to provide the <br />necessary leadership. [t was finally considered that no such meeting should <br />be held until the legislature had adjourned. By this time, whether or not <br />any bill would pass would be known and the leadership provided by the District <br />made more effective. In the interim. it was suggested that Mr. Ogilvie give <br />consideration to some of the principles that might be advanced at such meeting. <br /> <br />Mr. Ogilvie reported that the specifications on the 11 miles of tunnel being <br />the main tunnel and two auxiliary tunnels would be completed by the end of <br />the month. [t was hopeful that a con'tr,aet could be awarded in June or .July; <br />that $10 million was tentatively :allocated in the proposed a.ppropriations for <br />1966 for the Fryingpan Project; that the specifications on Sugar Loaf Heser- <br />voir could be completed by July, and a contract awarded in the late fall. He <br />reported that most of the right-of-way had been acquired at Ruedi, that they <br />would start the appraisal of the right-of -way for the railroad relocation at <br />Pueblo Reservoir in the near future. He reported that any publicity that <br />power might be dropped was false and that power was an essential part of the <br />project although it is possible that some modifications of the existing plans <br />would be made as the detail planning developed. <br /> <br />Mr. Jess Smith reported on recreational potential at Ruedi Reservoir; that <br />an agreement between the U. S. Forest Service and the Bureau of Reclamation <br />existed with reference to recreational facilities on public forest land; and that <br />such agreement included the Fryingpan Project.
