<br />U01l50 <br /> <br />Rules and Regulations <br />Relating To <br />Annual Operations <br /> <br />For example. 100 acre-teet may have been al. <br />lotted to a quarter section in 1939 and tbe quarter <br />later divided into two SO.acre tracts. To properly <br />reallocate the 100 acre-feet, the ownecB and lienhold- <br />ers interested in both 80's should join In a single ap- <br />plication (Form CD-21) to the Board requesting that <br />the 100 aCTe-teet be divided between the two 80's In <br />amounts agreed to by the owners. If approved and <br />ordered by tbe Board, tbe District, In accord with <br />its operating Rules and Regulations. w1l1 certify to <br />the carrier ditch company the amount of water de- <br />llverable to each owner. Similarly, the special assess- <br />ment and tax lien will be certified to the proper <br />County Assessor for collection through the County <br />Treasurer, <br />When an owner anticipates the sale or subdivi- <br />sion of a portion ot a. tract to which an allotment is <br />attached, it is suggested that Appllcation tor Real- <br />location be filed prior to conveyance, thereby elim- <br />inating the necessity tor subsequent agreement on <br />division of water between two or more parties. <br /> <br />RULES AND REGULATIONS <br />(1) Application for Reallocation shall be made <br />on the form turnished by the District for the <br />process above defined. <br />(2) Application tor Reallocation must be Joined in <br />by all owners of and lien holders against the <br />property specifically described in the original <br />Allotment Petition and Order. <br />(a) The signatures of all applicants shall <br />be acknowledged. <br />(3) The division of the Allotment must be agreed <br />upon hy all interested parties a.nd the Ap- <br />plication shall show; <br />(a) Legal description of each parcel of <br />land into which the original tract was <br />divided; <br />(b) the exact number of whole acre-foot <br />units, which upon approval of the <br />Board of Directors, shall attach to <br />each ot the described parcels of land. <br />(4) The Application, signed and acknowledged by <br />all parties in interest, shall be submitted to <br />the Secretary of the Board at the office of <br />the District, P. 0, Box 11 7, Loveland, Colo- <br />rado. The Board will hear, consJder and act <br />upon the ApplIcation at the earliest regular <br />meeting of the Board convenient to that pur- <br />pose. <br />(5) Prior to the entry of any Reallocation Order, <br />the District shall have in Its records the writ- <br />ten statement of an a.ttorney showing that <br />signers of the Application Me the sole per- <br />sons interested, either as owners or Uen hold- <br />ers, in the parcels of land Involved. <br />TRANSFER <br />Transfer of allotments, or portions of allotments, <br />is the process by which the Board ot Directors is <br />empowered. in the Conservancy District Act, to <br />transfer water from the lands to which water has <br />been allotted to other lands within the District and <br />to discharge liens from the lands to which the water <br />was first attached and to create liens upon tbe <br />other lands to which water is transferred. <br />As an example. allotment or water may have been <br />made in 1939 to lands where an irrigation well was <br />subsequently developed and the owner of the lands <br />needs none, or only part, of the water allotment. <br /> <br />DECLARATION OF QUOTAS <br /> <br />1. Since an acre-foot is deiined in all allotment <br />contracts as being one-three-hundred-l'en-thous- <br />andth (1/310,000) or the annual supply of water <br />apportioned for distribution by the District, <br />each year the Board of Directors will deter- <br />mine the amount to be apportioned and will <br />declare the same available in one or more <br />Quotas as follows: <br /> <br />Quota6 <br />1st (Basic Quota) <br />2nd (Supplemental Quota, it available and H <br />required) <br />Additional Quotas (If required by special con- <br />ditions) <br /> <br />Declaration Date <br /> <br />On or beiore March 31st <br />On or betore July 15th <br />On sllch dates as may be determined by the <br />Board <br /> <br />2. Upon declaration of each Quota, the District <br />will inform contract allottees of the quota of <br />water deliverable under the allotment con- <br />tracts. <br /> <br />Example:-It the 1st or Basic Quota is 217,- <br />000 acre-feet, an allottee whose contract calls <br />tor 100 acre-feet will have a tirst quota ol <br />217.000 divided by 310,000; than multiplied by <br />100, or 70 acre-leet. It the 2nd or Supplemen- <br />tal Quota is declared and amounts to 93,000 <br />acre-feet, the second quota. is computed in <br />the same way and will be 30 acre-feet. <br /> <br />While the example shows each "acf'8-foot unit" <br />to be a fulI acre-foot. the unit will vary annual- <br />ly depending upon the water supply available <br />for distribution. <br /> <br />3. Upon declaration of each quota, the District <br />wiH lorward lists, or revisions at lists, to all <br />carrier ditches, informing the ditch companies <br />of the Class D allollees and quotas deliverable <br />under that ditch system, <br /> <br />4. The Board ot Directors shall not he obligated <br />to list, for delivery by anj' ditch company. <br />the quota on any Class D allotment contract <br />where the lands described in the contract have <br />been divided in ownership and where the own- <br />ers thereof have not joined in an Application <br />to the Board of Directors tor the Reallocation <br />or Transfer of the originally allotted water <br />supply. <br />
