001 H~ A permanent transfer of all or part of the allot- ment and accompanying lien may be made to other lands by an application (Form CD.22) to the Board requesting such transfer. The Application tor Trans- fer must be signed by all owners and lienholders of both tracte ot land in the manner specftled In the Rules and Regulations. As in the case of an original allotment, the Board must determine the need for supplemental water on the lands to which the allotment would be trans- ferred and the approval ot the Application for Trans. fer will be made only after the Board, in Its judge- ment. has determined It to be for the best interest of supplemental water use within the District. RULES AND REGULATIONS (1) Application tor Transfer of Allotment must be joined in by all owners of and lien holders against, (a) the land from which an allotment, or portion thereof, is sought to be re- moved and, (b) the lands to which it Is reQuesl'ed that the allotment, or portion of allotment, be transferred. (c) The signatures of all applicants shall be acknowledged. (2) The Application. shall show: (a) the legal description of the lands to which the allotment and lien is at- tached and from which the same is, in whole or in part, to be removed; and (b) the legal description of the lands to which the allotment, or any part thereof, is to be transferred. (c) Lien holders by signing said Applica- tion must release or subordinate, as tbe case may be, their interest In the allotment and the assessment lien for said allotments. The Application, slgned and acknowledged by all parties in interest. shall be submitted to the Secretary of the Board at the office of the District, P. O. Box 117. Loveland, Colorado. The Board will hear, consider and act upon the application at the earliest regular meeting of the Board convenient to tbat purpose. Prior to the entry of any Transfer Order, the District shall have In its records the written statement of an attorney showing that sign- ers of the Application are the sole persons in- terested, either as owners or lien holders, In the parcels of land involved. Upon approval of the Board of Directors and the tiling of the Order granting the transfer In accordance with the judgement of tbe Board, the District shall record the Appllcation, Order, and any releases or subordination agreements deemed necessary, in the records of the County, or Counties, in which the lands involved are located. RULES .AND REGULATIONS The following Rules and Regulations were adopted by the Board of Directors of Northern Colorado Water Conservancy District tor the purpose of es. tablisbing the necessary controls and procedures for delivery of water allotted, as provided by the Con. Ren-ancy District Act., under Classes B, C, D. and Section 25; and, further, providing certain procedures to be followed by allottees ror the assurance of proper water delivery and assessment therefor, all in the interest of beneficial water use. In order to meet any requirements imposed by contracts with the United States or by the Conser- vancy District Act., these Rules and Regulations may be modified, amended or adLed to trom time to time as the Board or Directors may consider necessary or ad visable. DEFINITIONS (3) (1) The irrigation season is defined as the period beginning April 1st and ending October 31st. (2) An "acre-foot unit" of water is derined as being one.three.hundred-ten-thousandth (1/310,000) of the allnual supply apportioned for distribution. (3) Class B allotment - the right to use of water [or supplemental supply allotted by appropriate contract to a municipality. (4) Class C allotment - the right to use of water for supplemental irrigation purposes allotted by appropriate contract to an irrigation district. (5) ClaSB D allotment - the right to use of water [or supplemental irrigation purposes allotted to indiVidually described farm lands and the attachment to the described lands of a per- petual tax lien. (6) Section 25 allotment - the right to use o[ water for supplemental supply allotted by ap- propriate contract to mutual irrigation com. panies, industries or other corporations or en. tities. (4) (5) (7) Reallocation or a Class D Allotment is the pro- cedure used in dividing an original allotment among specified parcels of land within the boundaries of the tract of land described in tbe original Class D AJlotment Petition and Order. (8) Transfer of a Class D Allotment is the proced. ure of tranSferring all, or a portlon of an allot- ment, from lands to which water has been al- lotted to other lands or to other use contracts. (6) Forms of Application may be obtained from the District ottice.
