<br />001 H~ <br /> <br />A permanent transfer of all or part of the allot- <br />ment and accompanying lien may be made to other <br />lands by an application (Form CD.22) to the Board <br />requesting such transfer. The Application tor Trans- <br />fer must be signed by all owners and lienholders of <br />both tracte ot land in the manner specftled In the <br />Rules and Regulations. <br /> <br />As in the case of an original allotment, the Board <br />must determine the need for supplemental water on <br />the lands to which the allotment would be trans- <br />ferred and the approval ot the Application for Trans. <br />fer will be made only after the Board, in Its judge- <br />ment. has determined It to be for the best interest <br />of supplemental water use within the District. <br /> <br />RULES AND REGULATIONS <br /> <br />(1) Application tor Transfer of Allotment must be <br />joined in by all owners of and lien holders <br />against, <br /> <br />(a) the land from which an allotment, or <br />portion thereof, is sought to be re- <br />moved and, <br />(b) the lands to which it Is reQuesl'ed that <br />the allotment, or portion of allotment, <br />be transferred. <br />(c) The signatures of all applicants shall <br />be acknowledged. <br />(2) The Application. shall show: <br /> <br />(a) the legal description of the lands to <br />which the allotment and lien is at- <br />tached and from which the same is, <br />in whole or in part, to be removed; <br />and <br /> <br />(b) the legal description of the lands to <br />which the allotment, or any part <br />thereof, is to be transferred. <br /> <br />(c) Lien holders by signing said Applica- <br />tion must release or subordinate, as <br />tbe case may be, their interest In the <br />allotment and the assessment lien for <br />said allotments. <br /> <br />The Application, slgned and acknowledged by <br />all parties in interest. shall be submitted to <br />the Secretary of the Board at the office of <br />the District, P. O. Box 117. Loveland, Colorado. <br />The Board will hear, consider and act upon the <br />application at the earliest regular meeting of <br />the Board convenient to tbat purpose. <br /> <br />Prior to the entry of any Transfer Order, the <br />District shall have In its records the written <br />statement of an attorney showing that sign- <br />ers of the Application are the sole persons in- <br />terested, either as owners or lien holders, In <br />the parcels of land involved. <br /> <br />Upon approval of the Board of Directors and <br />the tiling of the Order granting the transfer <br />In accordance with the judgement of tbe Board, <br />the District shall record the Appllcation, <br />Order, and any releases or subordination <br />agreements deemed necessary, in the records <br />of the County, or Counties, in which the lands <br />involved are located. <br /> <br />RULES .AND REGULATIONS <br /> <br />The following Rules and Regulations were adopted <br />by the Board of Directors of Northern Colorado <br />Water Conservancy District tor the purpose of es. <br />tablisbing the necessary controls and procedures for <br />delivery of water allotted, as provided by the Con. <br />Ren-ancy District Act., under Classes B, C, D. and <br />Section 25; and, further, providing certain procedures <br />to be followed by allottees ror the assurance of <br />proper water delivery and assessment therefor, all <br />in the interest of beneficial water use. <br /> <br />In order to meet any requirements imposed by <br />contracts with the United States or by the Conser- <br />vancy District Act., these Rules and Regulations may <br />be modified, amended or adLed to trom time to time <br />as the Board or Directors may consider necessary or <br />ad visable. <br /> <br />DEFINITIONS <br /> <br />(3) <br /> <br />(1) The irrigation season is defined as the period <br />beginning April 1st and ending October 31st. <br /> <br />(2) An "acre-foot unit" of water is derined as being <br />one.three.hundred-ten-thousandth (1/310,000) of <br />the allnual supply apportioned for distribution. <br /> <br />(3) Class B allotment - the right to use of water <br />[or supplemental supply allotted by appropriate <br />contract to a municipality. <br /> <br />(4) Class C allotment - the right to use of water <br />for supplemental irrigation purposes allotted <br />by appropriate contract to an irrigation district. <br /> <br />(5) ClaSB D allotment - the right to use of water <br />[or supplemental irrigation purposes allotted <br />to indiVidually described farm lands and the <br />attachment to the described lands of a per- <br />petual tax lien. <br /> <br />(6) Section 25 allotment - the right to use o[ <br />water for supplemental supply allotted by ap- <br />propriate contract to mutual irrigation com. <br />panies, industries or other corporations or en. <br />tities. <br /> <br />(4) <br /> <br />(5) <br /> <br />(7) Reallocation or a Class D Allotment is the pro- <br />cedure used in dividing an original allotment <br />among specified parcels of land within the <br />boundaries of the tract of land described in tbe <br />original Class D AJlotment Petition and Order. <br /> <br />(8) Transfer of a Class D Allotment is the proced. <br />ure of tranSferring all, or a portlon of an allot- <br />ment, from lands to which water has been al- <br />lotted to other lands or to other use contracts. <br /> <br />(6) Forms of Application may be obtained from <br />the District ottice. <br />
