<br />. <br /> <br />. <br /> <br />c" <br /> <br />(2) OM&R Contract <br /> <br />r . <br /> <br />,~ <br /> <br />~ <br />C; <br /> <br />,~~~ <br /> <br />A contract will be negotiated between the United States and <br /> <br />GVIC for operation and maintenance of the faeilities installed <br /> <br />under the salinity control program. <br /> <br />The contract will contain <br /> <br />the following provisions: <br /> <br />Pursuant to Public Law 98-569 dated October 30, 1984, <br /> <br />the Secretary of the Interior shall n:imburse the GVIC <br /> <br />for the costs of operation and maintenance to the extent <br /> <br />the costs exceed the expenses that lateral users under <br /> <br />the GVIC canal system would have incurred in the thorough <br /> <br />and timely operation and maintenance of their lateral <br /> <br />system absent the construction of the Grand Valley Unit. <br /> <br />It will be mutually agreed that, as of certain dates, <br /> <br />the base annual O&M cost for the GVIC are a certain amount. <br /> <br />The base cost will be indexed annually in accordance with <br /> <br />the Annual Irrigation Operation and Maintenance Cost Trends <br /> <br />Index published by the Bureau of Reclamation. The <br /> <br />reimbursement of costs in excess of the base cost will <br /> <br />be made in the fiscal year following the fiscal year in <br /> <br />which they occurred. <br /> <br />The GVIC will annually submit to <br /> <br />the Contracting Officer by October 15, or as soon as such <br /> <br />information can be compiled, a summary of the total, actual <br /> <br />O&M costs for the previous fiscal year, and the Contracting <br /> <br />Officer will reimburse the GVIC the difference between <br /> <br />the total, actual O&M costs and the indexed base O&M costs <br /> <br />within 30 calendar days of receiving said information. <br /> <br />18 <br />
