<br />(lQ14u(' <br /> <br />PrelilIlinary Report <br /> <br />-5- <br /> <br />September 27, 1960 <br /> <br />. <br /> <br />The problem of securing the experiences of the other states together with <br />a broad prospective of ground water problems as a whole, was approached <br />with the thought of a separate ground water section of the Western Resources <br />Conference which is set up by a joint operation of Colorado University, <br />Colorado State University, and Colorado School of Mines. The proposal <br />was made by letter from your consultants to Morris E. Garnsey, Ph. D., <br />Chairman of the Western Resources Conference, a copy of that letter is <br />attached hereto. The Ground Water Section was carried out as outlined <br />in the letterto Dr. Garnsey. The proceedings of the Ground "Vater Section <br />of the Vi;estern Resources Conference are being duplicated and should be <br />considered a part of this preliminary report. The success of the Ground <br />Water Section of the Western Resources Conference is attested to by the <br />appearance at the conference of ground water administrators, or their <br />representatives of eleven of the western states and the presentation by <br />separate papers and correspondence of representatives of three additional <br />states as well as participation by the Department of Interior and the <br />Department of Agriculture of the United States. We quote from the remarks <br />of Emmett B. C lark, Professor of Law, University of New Mexico, as <br />fottows: <br /> <br />. <br /> <br />"We believe that these proceedings of the Ground Water Section <br />will serve as valuable background or position papers to be <br />considered by the consultants, the Departmerrt of Natural <br />Resources, as well as the General Assembly in proposed <br />amendments or proposed new legislation." <br /> <br />The proceedings of the Ground Water Section of the Western Resources <br />Corrference provide the experiences of the ather states. By agreement <br />between the consultants, these proc~edings of the departments and representa- <br />tives are to be made available to all members of the Colorado General <br />Assembly. We believe that these proceedings and the summaries meet the <br />assigned task in that field only in the general sense. Further research in <br />analyzing the court cases and administrative regulations of the states would <br />be desirable. <br /> <br />. <br /> <br />In order to avoid duplication of work by either of the consultants, but to <br />provide for coordination between the consultants, the advisory comm ittee, <br />and its subc om m ittees, the work of the advisory com m ittee as we II as the <br />subcommittees and the arrangements in connection with the Ground Water <br />Section of the Western Resources Conference were the primary responsibil- <br />ity of David J. Miller. The drafting of the recommended amendme nts to <br />the present Colorado Ground Water Law was primarily that of Mr. Chutkow. <br /> <br />- 20 - <br />
