<br />of the administration" and conducive to arbitration under Article <br />VIIHD) of the Compact. <br />On March 26, 1985, the Colorado representatives notified the <br />Administration of possible violations of various provisions of the <br />Arkansas River Compact by the State of Kansas and Kansas water users. <br />At a special meeting of the Administration held on March 28, 1985, in <br />Garden City, Kansas, Colorado voted against resolutions proposed by <br />Kansas that certain issues related to the operation of Trinidad and Pueblo <br />reservoirs were subject to and appropriate for arbitration pursuant to <br />Article VIIHD). <br />The Administration then adopted a resolution authorizing an <br />investigation pursuant to Article VIIH HJ of the Compact of allegations of <br />violations of provisions of the Compact in Colorado and Kansas. The <br />resolution established a committee consisting of the Director of the <br />Colorado Water Conservation Board, J, William McDonald, or his <br />designee and the Chief Engineer of Kansas, David L. Pope, or his <br />designee to conduct the investigation. <br />At a meeting on June 3, 1985, the Investigating Committee agreed to <br />compile streamflow data and to prepare a series of mass curves as a first <br />step in the investigation. <br />At a meeting of the committee on July 12. 1985, the Investigating <br />Committee could not agree on the conclusions to be drawn from the mass <br />curves and il was agreed that Mr. McDonald and Mr. Pope would each <br />prepare a written report analyzing the mass curves. The reports were <br />exchanged on September 6, 1985. <br />At a special meeting of lhe Administration on July 12, 1985, at the <br />request of the Kansas representatives, the Administration agreed to <br />amend the March 28, 1985, resolution to include an investigation of <br />whether Colorado had complied with the provisions of Article V(F) of the <br />Compact. <br />On September 17, 1985, the investigating committee mel in Santa Fe, <br />New Mexico, to discuss the reports analyzing the mass curves. At the <br />meeting, Mr. McDonald and Mr. Pope were unable to agree on <br />conclusions to be drawn from the mass curves and agreed to submit their <br />reports to the Administration along with a separate statement explaining <br />the reasons for the differences in their conclusions. <br />At a special meeting of the Administration on October 8, 1985, the <br />Administration considered the separate reports and statements <br />submitted by Mr. McDonald and Mr. Pope and adopled the following <br />resolution regarding the status of the investigation: <br />"WHEREAS, pursuant to the Resolution of March 28th, 1985 an <br />Investigating Committee was constituted to investigate alleged violations <br />of the Arkansas River Compact: and <br />WHEREAS, in conjunction with the existing data and engineering <br />studies the Committee agreed to prepare a series of single and double <br />mass diagrams to analyze primarily the regimen of the Arkansas River; <br />and <br />WHEREAS, the Colorado representative to the Invesligating <br />Committee has concluded that further investigation of whether lhe <br />waters of the Arkansas River have been or are being materially depleted <br />in usable quantity or availability should first examine: (1) reduced <br />diversions by ditches in Colorado Water District 67; (2) the opera ling <br /> <br />II <br />
