<br />~ <br /> <br />water quali,ty criteria have not been adopted, these narrative <br />~ water quality criteria shall be implemented considering <br />~ appropriat~ information, including any criteria guidance issued <br />U1 by EPA under CWA ~ 304(a) and/or information in EPA's toxicity <br />~ databases. For substances where numeric criteria have not been <br />adopted for the public water supply use, these narrative water <br />quality criteria shall be implemented considering any drinking <br />water criteria or health advisories issued by EPA under the Safe <br />Drinking Water Act. <br /> <br />Point source discharge implementation of (A) (4) shall result in <br />appropriate whole effluent toxicity (WET) limitations as <br />described in the latest edition of the EPA Region VIII NPDES <br />Whole Effluent Toxics Control Program document. <br /> <br />VI NARRATIVE BIOLOGICAL CRITERIA <br /> <br />(A) Criteria <br /> <br />Reservation waters shall be free from substances, whether <br />attributable to human-induced point source discharge or <br />nonpoint s~urce'activities, in concentrations or <br />combinations which would impair the aquatic community. <br /> <br />1 <br />~ <br />, <br />~ <br />~ <br />~ <br />" <br />~ <br /> <br />(B) purpose and Implementation <br /> <br />The intent of the Tribe in adopting a narrative biological <br />criteria is solely to provide an additional assessment <br />tool that can be used to identify impaired surface waters. <br />At this point in time, regulatory or enforcement actions based <br />solely on the Tribe's narrative biological criteria, such as <br />development and enforcement of NPDES permit limits, are not <br />authorized. However, biological assessment information may be <br />used in combination with other information, for example, to <br />assist in determining whether existing permits are fully <br />protecting designated uses and to assist in determining whether <br />new or revised chemical-specific permit limitations are needed. <br />In addition, the scope of how the Tribe's narrative biological <br />criterion is used may change in the future as the Tribe becomes <br />more experienced and confident in its biological assessment <br />program. I~plementation shall be based on comparison of current <br />biological: conditions at a particular site to the conditions <br />deemed attainable based on an appropriate reference site or <br />condition.
