The Tribe's review process will <br />consider the most recent EPA Region VIII guidance when preparing <br />its an anti degradation review process. <br /> <br />V NARRATIV)!: WATER QUALITY CRITERIA <br /> <br />All surfac~ waters within the reservation boundaries are subject <br />to the following narrative criteria; however, discharge of <br />substances regulated by permits which are within those permit <br />limitations shall not be a basis for enforcement proceedings <br />under these narrative criteria: <br /> <br />(A) Criteria <br /> <br />Reservation surface"waters except constructed wetlands shall be <br />free from substances attributable to human caused point source or <br />nonpoint source discharge in amounts, concentrations or <br />combinations which: <br /> <br />(1) can settle to form bottom deposits detrimental to <br />the existing beneficial uses; or <br /> <br />(2) form floating debris, scum, or other surface <br />materials sufficient to harm existing beneficial <br />uses; or <br /> <br /> <br />(3) produce color, odor, or other conditions in such a <br />degree as to create a nuisance or harm existing <br />benefic~al uses or impart any undesirable taste to <br />significant edible aquatic species or to the water; <br />or <br /> <br />" <br /> <br />" <br />:t <br /> <br />(4) are harmful to existing beneficial uses or toxic to <br />humans, animals, plants, or aquatic life; or <br /> <br />(5) produce a predominance of undesirable aquatic life or animals <br />which are detrimental to existing beneficial uses; or <br /> <br />j <br />-'i <br /> <br />.,,' <br /> <br />(6) cause a film on the surface or produce a deposit on <br />shorelines which are detrimental to existing beneficial uses. <br /> <br />(B) Implementation <br /> <br />The narrative water quality criteria shall be implemented taking <br />into consideration appropriate EPA technical guidance concerning <br />development .of water quality-based controls, such as methods <br />described in the Technical SU2port Document for Water Quality <br />Based Toxic 'Control, EPA, 1991.
