-16-

not receive any cash from John L. Samples.

(e) In the absence of an interview with John L. Samples

which might explain these transactions, we conclude that

he "sold" some water to the farmers under the Weldon

Valley Ditch which had already been sold to others,

and retained the money paid by the Weldon Valley farmers

himself .

THE PElF C-BT WATER SALE

1. Allegation

It was alleged that John L. Samples had earned a large com-

mission by handling a sale of C-BT water allotments for Reuben

Peif.

2. Conclusion

John L. Samples did not receive any commission from Reuben

Peif on the sale of Peif's C-BT water rights. Samples did handle

earlier seasonal leases of these same rights, but in the absence

of information from Samples, it has not been determined who

leased the water from Peif, nor how much the lessee paid, nor

whether Samples got a commission from the lessee. A review of the

NCWCD records might indicate who the lessee was, and the lessee

could then be contacted to ascertain if he paid any commission to

Samples.

ALLYN WIND EPISODE

1. Allegation
Allyn Wind of Hillrose had water for sale. Samples bought

it from him for cash. Samples brought the cash in an envelope.

A few days later Wind's neighbor bought the water from Samples

for two or three times what Wind had received.
,

WOODW~RO.CLYDE.~HER"'RD AND ASSOCIATES

~..~-

I
.

~: '. .
