-11-

.'

by the Bijou Irrigation Company, of some of its C-BT water allot-

ments. Allegations were made that Samples used the money from

the commission to build a building in Brush (together with his

friend Joe Howell). Allegations were also made that Samples ori-

ginally tried to persuade the Bijou Company to seel the allotments

for $7.00 or $8.00 per share, when they were worth far more.

2. Conclusions

We conclude that the allegations concerning John L. Samples

and the sale of C-BT units by the Bijou Company are not true, but

that he perhaps inadvertently gave reason for such rumors to arise

by sitting in on the negotiating sessions between the Bijou

Company and the buyers. We cannot absolutely rule out the possi-

bility that the Bijou paid him a commission by means of a warrant

drawn to him or to cash, but this could be determined only by an

audit of the Bijou books. The Bijou officials deny it. Although

we did not interview officials of the City of Boulder, the Fort

Collins-Loveland Water District, or the Little Thompson Valley

Water District, and so cannot rule out a commission having been

paid to Samples by one of those entities, the possibility seems

extremely remote on the basis of the facts we have learned.

THE NICK DEMITROFF EPISODE
1. Allegation
It was alleged that Nick Demitroff sold his water in 1964
through John L. Samples and that Samples later delivered water
to Demitroff from the river.
2. Conclusion
We arrived at no conclusion about this allegation. We found
no evidence to support it and no evidence to disprove it.

WOODWARD.CLYDE.SHERARD AND ASSOCIATES
