<br />-13- <br />THE "MORGAN PLAN" EPISODE <br />1. Allegations <br />We heard a great variety of complaints centering around an <br />episode in May of 1966 when the Schneider Ditch, in~ Water District <br />No. 64, had been short of water and had called for water and, <br />despite this call, it was alleged that John L. Samples had allowed <br />the junior Weldon Valley Ditch to continue taking water. It was <br />also alleged that the Weldon Valley Ditch Company had paid Samples <br />for this privilege. <br />2. Conclusions <br />We conclude that John L. Samples was acting under orders from <br />his superior, M. William Mattern, the Division Engineer, when he <br />allowed the Weldon Valley Ditch to run water out of priority in <br />May of 1966, despite calls on the river from senior priorities <br />downstream. We further conclude that although there may have <br />been a misunderstanding by the State water officials as to whether <br />or not the water users in Water District No. 64 had "agreed" to <br />try the "Morgan Plan" on a voluntary basis, the plan itself was <br />in violation of Colorado Water Law and the State water officials <br />appear to have acted under strong outside political pressures in <br />attempting to institute the plan. We find no evidence that John <br />L. Samples was paid any money by anyone in connection with this <br />episode. <br /> <br />THE PREWITT-RIVERSIDE "KICK-BACK" EPISODE <br />1. Allegations <br />It was alleged, in a number of different ways, that John L. <br />Samples had, over a period of years, received "kick-backs" or <br />"commissions" on the rental of Prewitt Reservoir rights from <br /> <br />WOOOWARD.CLYDE.SkERARD AND ASSOCIATES <br />
